geological, hydrological, and biological studies to identify the impacts and to <br />address the required mitigation. (findings 16, 17, 20, 21 & 22) <br />6. Restoration of the shoreline when disturbed and landscaping of the general area <br />would be provided by the Applicant in a manner that would mitigate visual <br />impacts, as well as mitigating any impacts to water quality and the sensitive <br />areas. There are no federal or state mandated cleanups required at the subject <br />property. (findings 10, 18 & 19) <br />7. Parking would be provided in a manner that is consistent with the regulations of <br />the City of Everett, as well as the Washington Shoreline Act. No parking would <br />occur in the shorelinE! area or within the buffers, and parking would be an <br />accessory to the proposed use rather than a main use. (finding 26) <br />The industrial use as proposed by the Applicant is allowed in the Urban Mixed <br />Industrial area, which are the uplands of the subject property. No industrial use <br />is being proposed for the Aquatic Conservancy designated area, which is the <br />Snohomish River. There would be a reduced buffer from the required 200 feet. <br />(findings 5, 10 & 27) <br />As proposed by the Applicant, the reasonable use exception is acceptable. <br />There is no other reasonable use or feasible alternative to the proposed <br />development that would have less of an impact on the environmentally sensitive <br />areas of the subject property. (findings 27-36) <br />10. The proposed development does not pose a threat to the public health, safety, or <br />welfare nor to any surrounding properties. (findings 31 & 32) <br />11. The reasonable use exception for the reduced buffer is the minimum necessary <br />for a reasonable use of the subject property. (finding 33) <br />12. The alterations of the buffer, including the reduction of the buffer, are not the <br />result of any actions of the Applicant. (findings 34 & 35) <br />13. The reasonable use exception would not create additional impacts on the <br />environmentally sensitive area. The reduced buffer preserves the <br />environmentally sensitive area to the maximum extent possible. (finding 36) <br />DECISION <br />Based upon the preceding Findings of Fact and Conclusions and testimony and <br />evidence submitted at the public hearing, it is hereby ordered a Shoreline Substantial <br />Development Permit and Review Process II (reasonable use exception) for a steel <br />fabrication and storage facility is granted for property at 2000-2200 Block of Ross <br />Avenue, Everett, Washington. The Shoreline Permit and reasonable use exception are <br />granted subject to the following conditions: <br />
