CONCLUSIONS BASED ON FINDINGS <br /> 1. The Applicant is the owner of the property at 7307 Evergreen Way that is zoned <br /> by the City of Everett as E-1, Evergreen Way. The proposed land use for the <br /> subject property is an auto dealership that would include auto sales and service <br /> shops. The property is in a mixed use corridor on one of the busiest streets in <br /> the City of Everett. The slope of the site requires designs that can be used for <br /> the commercial development of the site. The historical use of the site as an auto <br /> dealership and the proposed continuous use of the same will allow continuity of <br /> commercial development in the area. (finding 1) <br /> 2. The requested variance for the allowance of the garage doors to be placed less <br /> than 150 feet from a residentially zoned property and facing that property is <br /> necessary because of the topography of the site and its use. The variance will <br /> allow features of that commercial development to occur that are general to the <br /> site. (findings 12 and 13) <br /> 3. The variance will not be detrimental to the property in the area of the subject <br /> property. No opposition from the property owners to the south was expressed. <br /> There will be landscaping and buffers between the properties. (finding 10) <br /> 4. The variance will allow the property to be developed with similar designs enjoyed <br /> by other properties in the area. The City has allowed another variance similar to <br /> the proposed variance for an auto dealership along Evergreen Way. (findings 7 <br /> and 13) <br /> 5. The requested variance is the minimum to allow the subject property the general <br /> rights available on other properties in the area. The variance is necessary to use <br /> the existing ramp and develop the building to its fullest. (findings 7, 9 and 13) <br /> 6. The granting of the variance is consistent with the Goals and Policies of the <br /> Everett General Plan. (findings 8 and 9) <br /> 7. The need for the requested variance is not the result of a self-created hardship. <br /> The topography of the site necessitates the development in a manner that will be <br /> consistent with other properties in the area. (findings 12 and 13) <br /> DECISION <br /> Based upon the preceding Findings of Fact and Conclusions and testimony and <br /> evidence submitted at the public hearing, it is hereby ordered that the requested <br /> variance from the Special Regulation section of Table 5.2 of the City of Everett <br /> Municipal Code, Section 19.5 (Note 45[a]) is granted. The Applicant is allowed to <br /> provide vehicle servicing and repair shops as part of the dealership within 150 feet of <br /> residentially zoned properties, and, may have garage doors face residential zones.
