2 <br /> ORDINANCE NO. <br /> An Ordinance establishing process for sale of City-owned real property and repealing <br /> Resolution No. 1984 <br /> Whereas,on September 19, 2006, the voters approved an amendment to the City Charter <br /> that deleted Section 15.8 and substituted the following: "In addition to the powers <br /> accorded to the City under the laws and constitution of the State of Washington with <br /> respect to the ownership and disposition of property, the Council may by ordinance <br /> provide regulation for the sale or lease of City property"; and <br /> Whereas, this Ordinance is intended to address only the process for sale of City-owned <br /> real property, leaving the process for the sale of City-owned personal property and the <br /> process for leasing City-owned real property to be addressed in separate ordinances; and <br /> Whereas,pursuant to RCW 35.22.280(3), First Class cities, such as Everett, have the <br /> power to dispose of any land acquired by the City as the interests of the City may require; <br /> and <br /> Whereas,pursuant to municipal law, the City may purchase and hold real property for <br /> corporate purposes, sell, lease or otherwise dispose of corporate property, and where <br /> there is no charter or statutory restriction, may make any contract necessary to enable it to <br /> carry out these powers; and <br /> Whereas, First Class cities, such as Everett, may, but are not required to, determine that <br /> real or other property is no longer needed for municipal purposes prior to the sale of such <br /> property and may, but are not required to, engage in a public bid process prior to the sale <br /> of such property. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Sale of real property— Council resolution required. <br /> The City may sell and convey real property of the City if the City Council first <br /> determines by resolution that the property is no longer required for City purposes or <br /> determines by resolution that the sale of such property is in the best interest of the City or <br /> will further the purposes of the City, and second, authorizes the sale or conveyance of <br /> such property. <br /> Section 2.
