RESOLUTION NO. 4883 A RESOLUTION providing for interim library and park services to the residents of the unincorporated island in southwest Everett located generally south of Casino Road between Evergreen Way and Airport Road WHEREAS, through the adoption of Ordinance No.2422-99, the City annexed the property generally described as the unincorporated island in Southwest Everett which is located generally south of Casino Road between Evergreen Way and Airport Road; and WHEREAS, pursuant to the referendum provisions found in Ordinance No. 2422-99 and Chapter 35.13 RCW, a referendum election was held on February 29, 2000, on the annexation described in Ordinance No. 2422-99 with the results of the election sustaining the City's annexation of the subject property; and WHEREAS, Resolution No. 4065 defines an Everett resident providing for a distinction between residents and non-residents in the City for the provision of certain City services; and WHEREAS, in accordance with Resolution No. 4065, the City's park and library provide certain services and fees differentiating between residents and non-residents; and WHEREAS, although there will be a period of time before the annexation will be deemed effective, the City would like to provide those residents of the area annexed per Ordinance No. 2422-99 the opportunity to avail themselves of certain City library and park services as Everett residents in accordance with the City policies concerning residents/non-residents pending the ultimate outcome of the annexation process; and WHEREAS, until the annexation is finalized and becomes effective, the City does not have the authority to provide other City services such as police, fire and code enforcement to the residents of the area annexed per Ordinance No. 2422-99; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVERETT THAT: For purposes of Resolution No. 4065, those individuals maintaining their primary residence within the area annexed to the City pursuant to Ordinance No. 2422-99 shall be deemed to be within the corporate City limits for purposes of determining "residency in Everett" for receiving library and park services on an interim basis.
