9 <br /> II. PROGRAM REQUIREMENTS <br /> A. Uniform Administrative Requirements <br /> As required by 24 CFR § 92.505(b), the Agency shall conform its performance under this <br /> Agreement to the requirements of OMB Circulars No. A-110 (relocated at 2 CFR Part 215 and <br /> implemented at 24 CFR Part 85), A-122, and A-133, as applicable, as they relate to the <br /> acceptance and use of federal funds under this agreement. <br /> B. Other Federal Requirements <br /> The federal requirements set forth in 24 CFR § 92.350 are applicable to the Agency as a <br /> subrecipient of ADDI funds. The requirements of that section include: nondiscrimination and <br /> equal opportunity; disclosure requirements; debarred, suspended or ineligible contractors; and <br /> drug free workplace. The federal nondiscrimination requirements set forth at 42 U.S.C. <br /> § 12832 and relating to race, color, national origin, religion, sex, age and non-disqualifying <br /> handicaps also are applicable. <br /> C. Minority Outreach <br /> The Agency shall take affirmative action to encourage the use of minorities' and women's <br /> business enterprises (hereinafter "WMBE") in connection with ADDI-funded activities. In order <br /> to meet this goal, the Agency shall, for all its Project contracts funded wholly or in part with <br /> County ADDI funds, demonstrate a good faith effort to attain 7.7% WMBE participation. The <br /> Agency shall submit an annual report to the County of all contracts over $1,000 funded by <br /> ADDI funds. <br /> D. Environmental Review <br /> 1. NEPA <br /> Pursuant to 24 CFR § 92.352(b)(1), the County retains responsibility for environmental review, <br /> decisionmaking and action for purposes of fulfilling requirements of the National Environmental <br /> Policy Act and the related authorities for each activity carried out with ADDI funds. The Agency <br /> is responsible for completing an overall environmental review for the Project and for each <br /> homebuyer activity. The Agency must submit completed environmental reviews to the County <br /> for its approval before funds can be committed. The Agency shall not commit any funds for <br /> property acquisition prior to the environmental clearance. Any violation of this provision will <br /> result in the denial of funds under this Agreement. <br /> 2. SEPA <br /> The Agency retains responsibility for fulfilling the applicable requirements of the State <br /> Environmental Policy Act and regulations and ordinances adopted thereunder as they pertain to <br /> activities undertaken pursuant to this Agreement. <br /> ADDI Agreement between Page 4 of 23 <br /> City of Everett and Snohomish County <br /> 69 <br />
