4 <br /> Section 11: AMENDMENTS TO THE IFC APPENDIX D, FIRE APPARATUS ACCESS <br /> ROADS. <br /> A. Subsection D103.3 of Appendix D to the IFC, entitled "Turning radius" is hereby deleted and <br /> the following inserted in its place: <br /> D103.3 Turning radius. The fire apparatus access road shall have a 35 foot <br /> minimum inside turning radius and a 55 foot minimum outside turning radius. <br /> Section 12: The City of Everett hereby declares that should any section, paragraph, sentence or <br /> word of this Ordinance or of the International Fire Code, 2003 edition and its appendices, or any <br /> of the additions, deletions and exceptions thereto made by the State of Washington through its <br /> Building Code Council, be declared for any reason to be invalid, it is the intent of the City of <br /> Everett that it would have passed all portions independent of the elimination herefrom of any <br /> such portion as may be declared invalid. <br /> Section 13: This Ordinance shall not be construed nor held to repeal Ordinance No.'s 2360-99, <br /> 2075-95, 1880-92, 1752-90, 1255-86 or 724-80 as to any offense committed against such former <br /> ordinance or as to any act done, any penalty, forfeiture or punishment so incurred, or any right <br /> accrued or claim arising before under the former ordinance, or in any whatever to affect any such <br /> offense or act so committed or so done, or any penalty, forfeiture or punishment so incurred or <br /> any right accrued or claim arising before this ordinance takes effect. <br /> Nothing contained in this section shall be construed as abating any action now pending under or <br /> by virtue of Ordinance No.'s 2360-99, 2075-95, 1880-92, 1752-90, 1255-86 or 724-80 or as <br /> discontinuing, abating, modifying or altering any penalty accrued or to accrue, or as affecting <br /> this liability of any person, firm or corporation, or as waiving any right of the City under the <br /> above referenced ordinances or provision thereof in force at the time of passage of this <br /> ordinance. <br /> Section 14: Ordinance No. 2360-99 and all other ordinances in conflict herewith are hereby <br /> repealed. <br /> Section 15: <br /> (a) The purpose of the Everett Fire Code is to prescribe regulations consistent with nationally <br /> recognized good practice for safeguarding, to a reasonable degree of protection for the life and <br /> property of our citizens from the hazards of fire and explosion, arising from the storage, handling <br /> and use of hazardous substances, materials and devices, and from conditions hazardous to life or <br /> property in the use of occupancy of buildings or premises. <br /> (b) It is expressly the purpose of this Code to provide for and promote the health, safety and <br /> welfare of the general public, and not to create or otherwise establish or designate any particular <br /> class or group of persons who will or should be especially protected or benefited by the terms of <br /> this Code. <br /> (c) It is the specific intent of this Code to place the obligation of complying with its requirements <br /> upon the permit applicant and any person owning, operating or controlling any building or <br /> structure within the scope of this Code that no provision nor term used in this Code is intended to <br /> Z 1 13 <br />
