' J <br /> group of persons who will or should be especially protected or benefited by <br /> the provisions in this Ordinance. This Ordinance is not intended to be, nor <br /> shall be, construed to create any basis for liability on the part of the City, its <br /> officers, employees or agents ("City") for any injury or damage that an <br /> individual, class or group may claim arises from any action or inaction on the <br /> part of the City. <br /> Nothing contained in this Ordinance is intended to, nor shall be construed to, <br /> impose upon the City any duty that can become the basis of a legal action for <br /> injury or damage. <br /> Section 9. No effect on pending case or matter. <br /> The enactment of this Ordinance shall not affect any case, proceeding, <br /> appeal or other matter currently pending before the City or in any court. <br /> Section 10. Authority to make necessary corrections. <br /> The City Clerk and the codifiers of this Ordinance are authorized to make <br /> necessary corrections to this Ordinance including, but not limited to, the <br /> correction of scrivener's clerical errors, references, ordinance numbering, <br /> section/subsection numbers and any references thereto. <br /> Section 11. Enforcement. <br /> Violations of this Ordinance are punishable under EMC, Chapters 1.16, 1.20, <br /> 5.120, 5.124, and 5.128 and as otherwise provided by law and in EMC <br /> 1.20.020, and are subject to injunctive and other forms of civil relief which the <br /> City may seek. <br /> Section 12. Effective Date. <br /> It is necessary to pass this Ordinance as an emergency to preserve the status <br /> quo. If not adopted as an emergency ordinance, then there would be a period <br /> of time within which homeless encampments could establish such facilities <br /> and possibly obtain vested rights which would be incompatible with the <br /> regulatory scheme to be considered and prepared as a result of this <br /> Ordinance. This Ordinance, as a public emergency ordinance, is necessary <br /> for the protection of the public health, safety and welfare, and shall take effect <br /> and be in full force immediately upon its becoming valid. Within sixty (60) <br /> days of the effective date of this Ordinance, the City Council shall hold a <br /> public hearing on the adopted interim regulation. <br /> Section 13.
