7 AN ADDENDUM TO THE INTERLOCAL AGREEMENT BETWEEN THE CITY OF EVERETT AND THE EVERETT PUBLIC FACILITIES DISTRICT RELATING TO THE CITY'S HOTEL-MOTEL TAX DISTRIBUTION This Interlocal Agreement (Agreement) is made and entered into this day of , 2007 by and between the CITY OF EVERETT, a Washington municipal corporation (City) and the EVERETT PUBLIC FACILITIES DISTRICT, a Washington municipal corporation, (District) to assist in the reduction of the Events Center indebtedness. RECITALS WHEREAS, the parties hereto are municipal corporations, are governed by the provisions of Chapter 39.34, the Interlocal Cooperation Act, and intend to proceed thereunder; and WHEREAS, the City under the authority of Chapter 67.28 RCW, in EMC 3.64.010, imposes and levies a special excise tax on the sale of or charge made for the furnishing of lodging by a motel, hotel, rooming house,tourist court, trailer camp and granting similar license to use real property under the provisions of Chapter 67.28 RCW, such tax funds to be used for the purposes of promoting tourism, supporting tourist- related facilities, and other purposes as set forth in Chapter 67.28 RCW; and WHEREAS, the City collects such tax monthly through the Department of Revenue; and WHEREAS, Chapter 67.28 RCW provides guidance and direction as to the use of these funds to promote tourism through community attractions and entertainment events; and WHEREAS, the City under Chapter 35.57 RCW formed the Facilities District and the District constructed and now operates the Everett Events Center; and WHEREAS, the Everett Events Center serves as a tourism-related facility and is a destination for community attractions and entertainment events and attracts tourists and visitors to the City; and WHEREAS, in 2000,the Lodging Tax Advisory Committee and the Everett City Council Finance Committee recommended that the Everett City Council distribute $100,000 of Hotel/Motel Tax funds in concert with the City of Everett's 2001 Operating Budget; and 16 1
