6 <br /> RESOLUTION No. <br /> A Resolution authorizing the sale of certain real property <br /> located along the Snohomish River between Rotary Park and <br /> Pacific Avenue (generally known as the Riverfront Properties) <br /> pursuant to a Property Disposition Agreement. <br /> Whereas, for more than a decade, the City of Everett("City") has pursued various <br /> opportunities to provide for or facilitate the cleanup, environmental conservation, public <br /> shoreline access, and redevelopment of several properties currently owned by the City on <br /> the Snohomish River and generally referred to as the Riverfront Properties, including the <br /> landfill site, portions of the former Simpson Mill site, the former Eclipse Mill site, certain <br /> former rail right-of-way parcels and certain waterfront parcels; and <br /> Whereas, the City has also conducted plan-level environmental review and prepared <br /> plan-level SEPA documents with respect to its Shoreline Master Program, <br /> Comprehensive Plan and implementing development regulations relating to the <br /> Riverfront Properties (collectively herein, the "City Adopted Plans and Development <br /> Regulations"), for which any appeals have been resolved and all appeal periods have <br /> expired; and <br /> Whereas, the City Adopted Plans and Development Regulations determine a <br /> development and public use vision and appropriate land uses, set forth shoreline and <br /> comprehensive plan designations and policies, and establish development regulations <br /> relating to the redevelopment of the Riverfront Properties; and <br /> Whereas, the City's previous consideration of plans for redevelopment of the Riverfront <br /> Properties has been the subject of a phased review process under the State Environmental <br /> Policy Act, Chapter 43.21C RCW("SEPA") as described in a scoping notice issued by <br /> the City's SEPA Responsible Official on October 16, 2006; and <br /> Whereas,certain parcels of real property comprising the bulk of the Riverfront <br /> Properties are more particularly described in Exhibit A, attached hereto and incorporated <br /> herein by this reference (the "Property"); and <br /> Whereas, the sale of the Property on reasonable and lawful terms for redevelopment in a <br /> manner that is consistent with the City Adopted Plans and Development Regulations is in <br /> the best interest of the City and will further the purposes of the City; and <br /> 1 12 <br />
