5 <br /> WALL STREET BUILDING LEASE <br /> This Lease is made this day of , 2007, between the City of Everett; <br /> a municipal corporation under the laws of the State of Washington;hereinafter referred to as the <br /> "Lessor", and Senator Maria Cantwell, in her official capacity as a United States Senator, <br /> hereinafter referred to as "Lessee" and in accordance with and subject to the statutory <br /> requirements set forth in 2 U. S. C. 59 relating to home state office space for the United States <br /> Senate. <br /> WITNESSETH <br /> 1. PREMISES. The Lessor does hereby lease to Lessee, and Lessee does hereby lease <br /> from Lessor,those certain premises c ommonly known as Suite 9B , (hereinafter called <br /> "Premises"), being situated in the Wall Street Building located at 2930 Wetmore Avenue, <br /> Everett, Washington legally described as: <br /> All of Lots 18, 19, 20, 21, 22, 23, 24, 25, 26, 27 and Lot 28 EXCEPT Beginning at a <br /> point 2 inches South of the Northeast corner of said Lot 28, thence North to said Northeast <br /> corner; thence West along the North line of said Lot 28 to the Northwest corner thereof; <br /> thence South along the West line of said lot, 6 inches; thence Easterly in a straight line to the <br /> Point of Beginning; all in Block 683, Replat of Block 683, Plat of Everett, according to the <br /> plat thereof recorded in Volume 4 of Plats, page 49, records of the Auditor, of the County of <br /> Snohomish, State of Washington, <br /> together._with_.rights__bf._iiigress-_and egress_.over_.common areas incorporated herein by this • <br /> reference, which Premises consist of 306 usable square feet in size and are referred to herein as <br /> . the "Premises". Said space does not include "joint use space" such as common cafeterias, <br /> conference rooms,--snack bars,.janitorial,.mechanical or circulation_areas.as.defined_in 41 CFR <br /> 101-17.003-13. Further, Lessor agrees to-provide Lessee parking in accordance with Exhibit A, <br /> which is attached hereto and incorporated herein by reference. <br /> The.term.of_this.Lease.shall be fornix-(6)-years-commencing on January--1, <br /> 2007;and-end at midnight December 31, 2012. The term of this Lease may not exceed six years, <br /> and_shallin.no.caser extend beyondilie.xerm-0.f office_which.the Lessee is serving on the-first day <br /> of this Lease,.except that if the Lessee has been reelected for another term. Any month to month <br /> holdover tenancy, if applicable, shall be at the same base rent as in-effect at the expiration of this <br /> Agreement. Notwithstanding the,provisions ofany other section ofthis Lease, the Lessee and/or <br /> the-Sergeant at Arms of the United States Senate shall have-the right to terminate this Lease <br /> without penalty upon the Lessee'sdeath, resignation or.expulsion from.the.Senate... .This.right <br /> shall be exercised by providing sixty (60) days advance written notice to the.Lessor of the <br /> Lessee's or Sergeant at Arms'intention to terminate this lease: <br /> RENT.:..Lessee leases said-Premises.for-said period and agrees to pay a monthly-rental <br /> in the amount of Five Hundred Twenty Six Dollars and Eighty Three Cents ($526.83); including <br /> parking (an annual rate of $20.66 per square foot including parking).
