4 <br /> LICENSE TO USE CITY PROPERTY <br /> Grantor: City of Everett <br /> Grantee: EVERGREEN RECYCLING INC. <br /> Property: See attached Exhibit A and A-1 <br /> WHEREAS, EVERGREEN RECYCLING INC., whose address is: 506 2nd Ave, Suite <br /> #2200, Seattle, WA 98104 (Mailing: Po Box 3971, Seattle, WA 98124), hereinafter <br /> referred to as`EVERGREEN RECYCLING INC.", desires to utilize City owned <br /> property for the purpose hereinafter set forth; and <br /> WHEREAS, the City is willing to grant EVERGREEN RECYCLING INC. authority to <br /> use a portion of City's property upon certain terms and conditions; <br /> NOW, THEREFORE, in consideration of the premises, the promises contained herein, <br /> and other good and valuable consideration, the receipt and sufficiency of which is hereby <br /> expressly acknowledged, the City licenses EVERGREEN RECYCLING INC. to use <br /> City's property upon the following terms and conditions: <br /> 1. LICENSED PROPERTY. The specific one acre area of City owned property <br /> subject to this License is described in Exhibit A and A-1 ("Property"). <br /> 2. TERM. This License shall be effective upon execution by the Mayor of the City and <br /> shall expire on December 31, 2007, unless terminated earlier upon 30-days notice per <br /> Section 7 below. <br /> 3. AUTHORIZED USE. EVERGREEN RECYCLING INC. may only use the <br /> Property for the purpose of outdoor storage of tractor trailers and other equipment related <br /> to the loading and hauling of ash materials. <br /> 4. MONTHLY CONSIDERATION. EVERGREEN RECYCLING INC. shall remove <br /> a minimum of 33 tons of ash per month from the site as directed by the City. <br /> page 1 <br />
