It is in the best interest of <br /> the public in general,.and the owners and operators of motor vehicles in particular, to remove disabled, <br /> abandoned, or stolen vehicles as quickly as possible in order to reduce the likelihood of additional accidents, <br /> property loss, or injury. These owners or operators of such vehicles are often not in a position to negotiate <br /> the best possible price for towing or storage and have little control over whether the tow business makes the <br /> process for recovery of vehicles accessible and convenient. Because the rates charged and the quality of <br /> facilities and services can vary greatly between tow businesses it is in the best interest of the public in <br /> general and the owners and operators of motor vehicles in particular for the City to regulate the business of <br /> towing.companies and tow trucks and seek to obtain services at a competitive responsive rate. The city <br /> wishes that when a motor vehicle is impounded by the police department, its owner or operator shall pay a <br /> fait-and-consistent fee for towing services, with such fees to be established through a competitive process <br /> and set by contract. The schedule of maximum fees shall conform to, and not be less than, the schedule of <br /> maximum fees-then-In -effec sy the-_Washingt=o ..State Patrol. --sehedul1-of-m murrufees- y-be----- <br /> adjusted periodically by the police chief to conform to any adjustments made by the Washington State Patrol. <br /> to its schedule of maximum fees. The list of qualified class A licensed towing businesses shall be used when <br /> a police impound is involved. Any class A licensee shall not exceed the fees of such schedule for services <br /> rendered at the request of the police department or its dispatcher. Charging fees in excess of those specified <br /> in the fee schedule, or agreed to by contract, or charging for services not actually rendered, may result in the <br /> cancellation of any contract between a towing business and the City. <br /> RECOMMENDATION (Exact action requested of Council): Adopt the Proposed Ordinance relating to <br /> Towing Businesses and Tow Trucks, amending Section 11 of Ordinance No. 1830-91 (EMC 5.70.110) and <br /> Section 14 of Ordinance No. 1830-91 (EMC 5.70.140). <br /> 98 <br />
