3 <br /> (Approximately two weeks after deadline for completion of interviews) <br /> 3.3 City Answers and Addenda <br /> Changes to this RFP will be made only by formal written addenda issued by the City's <br /> RFP Coordinator. Any such addenda and City answers to questions will be issued no <br /> later than the date and time listed in Section 3.2 and only to those who asked questions <br /> and/or submitted a letter of interest that includes the email or fax of the interested party. <br /> Changes to this RFP may be made by the City if, in the sole judgment of the City, the <br /> changes will not compromise the City's objectives. <br /> 3.4 Proprietary Material <br /> Proposers should be aware that the City is required by law to make its records available <br /> for public inspection, with certain exceptions (see RCW Chapter 42.56). Proposers shall <br /> clearly mark any proprietary information contained in its Proposal with the words <br /> "proprietary information." Marking all or nearly all of a Proposal as proprietary may <br /> result in rejection of the Proposal. Proposers should be aware that even materials marked <br /> "proprietary information" may be subject to public inspection. The Proposer, by <br /> submission of materials marked proprietary, acknowledges and agrees that the City will <br /> have no obligation to advocate for nondisclosure in any forum nor any liability to the <br /> Proposer in the event the City must disclose these materials. <br /> 3.5 Delivery of Proposals <br /> The City will not consider Proposals submitted by facsimile. Proposers are solely <br /> responsible for ensuring that proposals are delivered on time, and proposals not timely <br /> submitted will not be considered. <br /> 3.6 Cost of participation in RFP process <br /> The City shall not be liable for any costs incurred by Proposers in the preparation, <br /> submittal of a proposal or participation in the RFP process. <br /> 3.7 Withdrawal of Proposals <br /> A proposal may be withdrawn by written request of the Proposer prior to the opening of <br /> the proposals on the date specified in Section 3.2. <br /> 3.8 Changes in Proposals <br /> Prior to the opening of the proposals, a Proposer may make changes and resubmit its <br /> proposal. <br /> X2 <br /> Everett Downtown Mixed-Use Development(Allen Buick/Culmback Property)-RFP Page 7 <br />
