3 <br /> 3.16 Indemnification/Waiver <br /> In submitting a proposal, the Proposer agrees to indemnify and hold the City harmless of <br /> all liability, risks, costs, claims, actions, suits, demands, losses expenses, injuries and <br /> damages of any kind arising directly or indirectly out of, or in connection with, the City's <br /> handling of the RFP process, including but not limited to, the rejection of any or all <br /> proposals. <br /> 4.0 RFP SPECIFICATIONS <br /> 4.1 Materials <br /> An ability to concisely present the information requested in this RFP will be viewed <br /> favorably. Each Proposal should contain: <br /> 1. A description of the project, including: <br /> a. Project concept, including character and quality. <br /> b. General development proposal consisting at least of a narrative description as well <br /> as conceptual visual depictions of the proposed project. <br /> c. Timeline of steps to define the project in enough detail to ascertain scope, budget <br /> and schedule. <br /> d. Schedule for completion of all phases of the project with construction <br /> commencing within at least 24 months of the closing date of the Property sale. <br /> e. Plan for marketing and leasing of the development on the Property. <br /> f. Statement as to whether the developer will commit to providing the City notice of <br /> proposed tenants of street level/ground floor space in the development and right of City <br /> to disapprove of proposed tenants who do not meet the criteria for providing a quality <br /> urban amenity, such as specialty retail or restaurant. <br /> g. Statement as to whether the developer will commit to participate in formal <br /> community outreach public meetings and hearings where the development proposed for <br /> the Property will be discussed. <br /> h. Plan for integrating the Culmback Building or its facade into the project design <br /> subject to the special requirements for a building on the City of Everett Register of <br /> Historic Places. 1 4 <br /> Everett Downtown Mixed-Use Development(Allen Buick/Culmback Property)-RFP Page 9 <br />
