CONCLUSIONS OF LAW <br /> Criteria and Standards for Review <br /> Review Criteria for Site-Specific Rezones - Under Chapter 19.41.160.B.2, Site-Specific <br /> rezones are subject to the following criteria: <br /> 1. The proposed rezone is consistent with the Everett Comprehensive Plan. <br /> 2. The proposed amendment bears a substantial relation to public health, safety or <br /> welfare; and the proposed rezone promotes the best long-term interests of the Everett <br /> community. <br /> 3. The proposed rezone mitigates any adverse impacts upon existing or anticipated land <br /> uses in the immediate vicinity of the subject property. <br /> Review Criteria for Modification of Multiple Family Development Standards —The following <br /> modifications are proposed: <br /> 1. Modification of Building Height— Building Height in the R-1(A) zone is limited to 28 feet, <br /> as set forth in the Development Standards Table (EMC Chapter 19, Table 6.1). <br /> 2. Modification of Building Separation — EMC Chapter 19.15.100 requires that buildings on <br /> the same lot be separated by 10 feet, plus an additional 10 feet for each floor above the <br /> first floor. A one-story building would have a separation requirement of 10 feet; two <br /> stories would be 20 feet and 3 stories would be 30 feet. <br /> Under EMC Chapter 19.15.010.D, modifications of Multiple Family Development Standards <br /> are subject to the following review criteria: <br /> a. The unique characteristics of the subject property and/or its surroundings and how <br /> they will be protected or enhanced by modifying the development standards or design <br /> guidelines. <br /> b. The positive characteristics of the proposed development and whether such <br /> characteristics could be provided by compliance with the development standards <br /> and/or design guidelines proposed to be modified. <br /> c. The arrangement of buildings and open spaces as they relate to other buildings and/or <br /> uses on the subject property and on surrounding properties. <br /> d. Visual impact to surrounding properties caused by parking facilities in the proposed <br /> development and whether such impacts are less than would result from compliance <br /> with the development standards and/or design guidelines proposed to be modified. <br /> e. If the development proposes greater building height than permitted by the zone in <br /> which the property is located, does the increase in building height result in an increase <br /> 8 <br /> 58 <br />
