ARTICLE 16 - SENIORITY <br /> Section 1: <br /> Working seniority will be determined from the date of hire as an employee covered under Article <br /> 4 for the City provided such service is continuous. <br /> Working seniority applies only to days off, run selection, vacations, holidays and overtime. <br /> Section 2: <br /> Seniority shall be recognized in the same classification of work and those having greater <br /> seniority shall be given preference as to work in the same position but shall not be in conflict <br /> with the rules of Civil Service as it applies to promotions. If there is a layoff in the operator <br /> series, prior paratransit operator time will be included in that individual's class of bus operator <br /> time for purposes of determining layoff seniority. <br /> Section 3: <br /> Seniority shall terminate by discharge from service or by voluntarily leaving the service of the <br /> Transit Division. <br /> Section 4: <br /> When and if it becomes necessary to lay-off any employee, the last person hired in each <br /> classification shall be the first laid off and the last person laid off shall be the first person hired <br /> when rehiring. <br /> Section 5: <br /> Employees under a medical leave of absence will not lose their seniority rights for one (1) year <br /> after their accrued sick leave is exhausted. During this period, the City has the right to require <br /> physician reports every 90 days, and to send the individual to a City-appointed physician.
