<br /> the City would not grant the varlance, the Owner agrees to defend, indemnify and
<br /> save hermiess the City, its appointed and elective officers, empioyees end agents
<br /> from and against all loss of expense including, but not limited to, judgments,
<br /> settlements, attorney's fees and costs by reeson of any and ell claims and aemends
<br /> upon the City, its elected or appointed officers or employees or egents, for
<br /> damages because of bodily injury, including death, at any time resulttng therefrom,
<br /> sustained by eny person or persons end on account of damage to pruperty, including
<br /> loss of use thereof, arising out of or in consequence of the City grenttng Owner the
<br /> variance. All references to indemnificatton include, but are not llmtted to
<br /> attorney's fees end court costs. However, thic peragraph does not purport to
<br /> indemnify the City against liability for damages erising out of bodily Iniury to
<br /> persons or damages to property caused by or resultIng from the sole negflgence of �
<br /> the City, its officers, agents end amployecs,
<br /> 2. Owner agrees that the rights end obllgations of this Agreement are
<br /> binding on his respective hetrs, successors or assigns and shall run with the land.
