ATTACHMENT A <br />(Revised) <br />The City shall be responsible for the maintenance and repair of <br />all sanitary sewers, pipes, mains and lines and related <br />equipment installed pursuant to this grant of easement. Any <br />maintenance and repair work on such lines and equipment shall. be <br />performed only after ten (10) days written notice to the Grantor <br />of the City's intention to do such work, except in the case of <br />emergency. Notwithstanding the above, no maintenance and repair <br />work shall be performed on such utility lines during the period <br />from November 15 of any calendar year to January 2 of the next <br />succeeding calendar year, except in an emergency. Any such work <br />shall be done without cost or expense to the Grantor and in such <br />manner as to cause as little disturbance in the use of the <br />Grantor's property and the business conducted thereon as may be <br />practicable under the circumstances. The City shall indemnify, <br />defend and hold the Grantor hamless from any and all mechanic's <br />liens, and from any loss, cost, damage and expense relating to <br />claims for personal injury or property damage arising out of the <br />maintenance or repair work., or out of any leakage or defect of <br />the City's utility lines located within the easement area, <br />except to the extent caused by the negligence of the Grantor. <br />The City shall be responsible for repairing any damage to the <br />Grantor's property and the improvements located thereon which <br />results from any leakage or defect of the City's utility lines <br />located within the easement area unless the leak was caused by <br />the negligence of the Grantor. Upon the completion of the <br />maintenance or repair work, the City shall restore the portion <br />of the Grantor's property affected by such work to the same <br />condition as it was before the commencement of the work. <br />Notwithstanding any of the language set forth in this <br />attachment, the City shall not be responsible for any costs, <br />damages, expenses, or mechanic's liens which are the result of <br />the installation of the sanitary sewage line or the domestic <br />water supply line, pipe, or mains by the Grant,.r, Titanic <br />Associates, or their agents. <br />87110301 67' <br />VOL.''099PGGEZ060 <br />} <br />
