� .. <br /> CITY ' [VERETT - BOARD OF ADJUSTMENi <br /> ORDER <br /> WHEREAS, theretofore, there was ffled wlth the City of Everett Planning <br /> Department on (date) January 22, 1975 an application for a vari- <br /> ance of Section No. 080 of Everett C,ty Code No. 15.04 by (applicant) <br /> Randall Robinson (address) 9505 Ist Avenue, Everett IVA <br /> for (specitic variance requested): --- <br /> permission to locate a 12 x 20 foot garage thirteen ( 13) feet from the front <br /> property line. The zoning ordinance requires a minimum of twenty (20) feet <br /> from the property line. <br /> �n the tollowing decribed property: <br /> Lot I, Block 9, Intercity Addition No. I except portion thereof described as <br /> follows: Beginning at the most northerly corner of said Lot I , thence south- <br /> easterly along northeasterly line thereof 100 feet to most easterly corner <br /> of said Lot I, thence southwesterly along southeasterly line of said lot 125 <br /> feet; thence northwesterly parallel to northeasterly line of said lot 100 <br /> feet to northwesterly line; thence northeasterly along said northwesterly Iine <br /> of Lot I a distance ot 125 feet to point of beginning; also except the south- <br /> westerly 80 feet of said Lot I . 9505 Ist Avenue - Everett ( Intercity) <br /> ANO: WHEREAS, (date) February 3, 1975 was fixed as the date of hearing <br /> on said application and proper notice having been given as required by law, <br /> ' AND: WHEREAS, a public hearing was held on said date ar.d the Board of <br /> Adjustment, after reviewing all testimony, made the findings that: <br /> I. That there are exceptional circumstances or conditions applying to the subject. <br /> property that do not apply to other properties in the same vicinity or zone, <br /> specifically that topographic conditions in the rear of the applicant's <br /> property prevent him from meeting Code requirements on the front yard setbacks, <br /> and further that the front of the existing structure lies II feet from the <br /> property iine and the garaye structure will be 2 feet behind the front of <br /> the dwelling. . <br /> 2. That such variance is necessary for the preservation and enjoyment of a <br /> substantial property right of the applicant possessed by owners of other pro- <br /> perties in the same vicinity or zone. Specifically that the proposed <br /> garage will meet all other set-back and code requirements, and the applicant <br /> has no alternaiive locations for the garage structure. <br /> 3. That the authorization of such variance will not be materially detrimental <br /> to �the public welfare or injurious to property in the vicinity, specifically <br /> that the pFoposed garage str-ucture will be further from the front property <br /> __ line than the existing house. <br /> 4. The granting of the variance will not adversely affect the comprehensive plan. <br /> NOW, THEREFORE, based on the foregoing findings: <br /> BE IT ORDERED BY THE CITY OF EVERETT BOARD OF ADJUSTMENT that said application be <br /> � GRANTED ; <br /> hND: 8E IT FINALLY ORDERED that a .copy of this written order be transmitted <br /> to the applicant for their information. <br /> DATE OF ACTION: February 3, 1975 <br /> Reid .
