.
,
June 16, 1988
Levon Kasparian
5015 Alki Drive
Mukilteo, Wa 98275 everett
Re: Stop work order for 9610 - lst Avenue SE. . . .... •
Dear Mr . Kasparian:
In response to a request by a concerned citizen, the I
Planning Department has done a site inspection at 9610 - lst
Avenue SE where a new single family residence is being
built. It was found that a ground water drainage course
exists along the north side of the property. The foundation
is within six feet of the stream which is shown in the South
Everett Drainage Basins Plan as a drainage tributary to
North Creek. The Drainage Basins Plan indicates that there
is potential for flooding in this drainage basin and that
the stream has an under capacity of 21 cfs to carry runoff
flows from a 25 year frequency storm.

The City of Everett Zoning Code, Chapter 19. 42.030
3ubsection C states that "No structure(s) to be used for
residential purposes, either for permanent residents or
transient guests, shall be constructed, placed or erected
within thirty feet of the nominal shorelirte of any lake,
stream, bay or other natural body of water" . Since the
tributary is hown on the drainage basins plan, any
construction on this lot would be subject to this section of
the Zoning Code. Therefore the Planning Department has
requested that the Public Works Department issue a stop work I
rder for this site. .
The site plan submitted for the buil.ding permit application
did not show the stream as required by the site plan
instructions (the City of Everett Minimum Requirements
Checklist, which accompanies the building permit
application) .
In order to resume construction, the setback issue must be
resolved. Two options exist to accomplish this. First you
could redesign the house so that it meets the setback
requirements set forth in the zoning code. To accomplish
this, however, the foundation must be removed and set back
thirty feet from the drainage course.
n 4
