Kasparian: <br /> In response to a request by a concerned citizen, the I <br /> Planning Department has done a site inspection at 9610 - lst <br /> Avenue SE where a new single family residence is being <br /> built. It was found that a ground water drainage course <br /> exists along the north side of the property. The foundation <br /> is within six feet of the stream which is shown in the South <br /> Everett Drainage Basins Plan as a drainage tributary to <br /> North Creek. The Drainage Basins Plan indicates that there <br /> is potential for flooding in this drainage basin and that <br /> the stream has an under capacity of 21 cfs to carry runoff <br /> flows from a 25 year frequency storm. <br /> � <br /> The City of Everett Zoning Code, Chapter 19. 42.030 <br /> 3ubsection C states that "No structure(s) to be used for <br /> residential purposes, either for permanent residents or <br /> transient guests, shall be constructed, placed or erected <br /> within thirty feet of the nominal shorelirte of any lake, <br /> stream, bay or other natural body of water" . Since the <br /> tributary is �hown on the drainage basins plan, any <br /> construction on this lot would be subject to this section of <br /> the Zoning Code. Therefore the Planning Department has � <br /> requested that the Public Works Department issue a stop work I <br /> �rder for this site. . <br /> The site plan submitted for the buil.ding permit application <br /> did not show the stream as required by the site plan <br /> instructions (the City of Everett Minimum Requirements <br /> Checklist, which accompanies the building permit <br /> application) . <br /> In order to resume construction, the setback issue must be <br /> resolved. Two options exist to accomplish this. First you <br /> could redesign the house so that it meets the setback <br /> requirements set forth in the zoning code. To accomplish <br /> this, however, the foundation must be removed and set back <br /> thirty feet from the drainage course. <br /> n 4 <br /> � <br />
