In response to a request by a concerned citizen, an ; <br /> inspection was done by the Planning Department. It was found <br /> Ithat a tributary of North Creek runs along the north side of the '; <br /> property and the foundation did not meet the 30 foot setback from <br /> the edge of the stream as required by code. A Stop Work order <br /> was issued by the Buildinq Permit Department j <br /> I <br /> iThe site plan submitted with the Building Permit application did I <br /> not show the stream as required in the City of Everett Minimum <br /> Fequirements Checklist for obtaining Building permits. Building �, <br /> Permits would not have �een issued if the site plan had shown the <br /> location of the stream, and the Applicant would have been asked <br /> to redesign or apply for a variance prior to issuance of permits. <br /> I <br /> FrNDINGS AND CONCLUSIONS: i <br /> I <br /> �� Criterion No. 1: I� <br /> That there have been exceptional or extraordinary circumstances�, <br /> or conditions applying to the subject property or as to the in-� <br /> tended use thereof that do not apply generally to otherl <br /> properties in the same vicirity or zone. <br /> a. Findina: When obtaining the building permits the builder. <br /> was not aware that it was necessary to show the stream oni <br /> the site plan and was not aware of the 30 foot setback, <br /> requirement. The checklist for Building Permit <br /> Application has now been revised to require the signature <br /> of the applicant verifying that he has read the checklist <br /> and is aware of all the requirements. <br /> The Applicant states they have spent $30,000 to date on <br /> this project and conforming to the 30 foot setback ; <br /> requirement would make the lot unbuildable since the <br /> lot is 65 feet wide and a 30 foot setback on o[�e side <br /> and a six foot setback on the other would only leave a <br /> 27 foot wide area to construct a house. <br />
