Findina: Inspection of the property by the City Drainage <br /> Engineer found that the foundation for this home is <br /> within approximately five feet of the top of the bank of <br /> the west fork of North Creek. The existing channel is <br /> only approximately two feet wide as it crosses the <br /> subject property. Although the subject property is <br /> approximately six feet higher than the stream, the <br /> property immediately to the north is very near stream <br /> level and likely floods already. Therefore, the stream <br /> channel should not be disturbed or fil)ed in any manner. <br /> There are a couple of locations where this has appeared <br /> to have occurred already. <br /> The existing stream channel makes a 90 degree turn just <br /> as it enters the subject property. This location will <br /> be highly susceptible to bank erosion, and bank <br /> erosion, if uncontrolled, may ultimately undermine the <br /> foundation. <br /> Any variance should be contingent upon compliance with <br /> conditions as recommended by Public Works in order to <br /> ' alleviate the above concerns. <br /> b. Conclusion: Compliance with conditions recommended by <br /> Public Works is necessary to assure that granting this <br /> variance would not be detrimental to the public welfare <br /> or injurious to other property in the vicinity or zone. <br /> Criterion No. 4• <br /> '� That the grantinq of such variance will not adversely affect the <br /> � Comprehensive General Plan. <br /> il a. Findina: The comprehensive plan designation for this <br /> area is single family residential. <br /> b. Conclusion: Granting of this variance will not adversely <br /> �, affect the comprehensive plan since the proposed use is <br /> , single family residential. <br /> il� NOW, THEREFORE, the Board of Adjustment of the City of Everett <br /> I does hereby order that the variance as requested by the Applicant <br /> be GRANTED, and further require the a�plicant to meet the <br /> ','; following conditions. <br /> 1. The Applicant shall install a filter fabric fence along the <br /> i top of the stream bank prior to release of thc: stop work <br /> � order. This will prevent silt from entering the stream during <br /> construction and form a physical barrier to discourage any <br /> construction activity (such as filling) within the stream <br /> channel. <br /> 2. Any loose fill material along the stream bank shall be removed <br /> ii prior to release of the stop work order. <br /> i 3. Grass sod shall be staked in place along the stream bank <br /> following completion of construction. <br /> ' 4. Prior to release of the stop work order, the Applican. shall <br /> install rip rap underlain by filter fabric along the stream <br /> bank where the stream makes a ninety degree turn onto the <br /> � property in order to prevent erosion of the bank. <br /> � 5. A hold harmless agreement for future damage claims resulting <br /> from stream erosion or floodinq shall be executed and recorded <br /> i prior to release of the stop work order. <br /> -2- <br /> � <br />
