DECISION RELATING TO CODE VIOLATION CA�iE #09-0857 <br /> Based upon the precediny Findings of Facts and Conclusions and lestimony and <br /> evidence submitted at lhe code violalion public hearing, it is hereby ordered thal: <br /> ORDER <br /> 1. The current Stop Work Order that was posted by lhe Ciry uf Everett Building <br /> Services Deparlment at 10405 - 3rd Avenue SE, Everett, Washington, shall <br /> remain posted and in eifect until such lime as it is withdrawn by an authorized <br /> sta(f inember of the City of Everett. <br /> 2. No construction activily of any kind is to lake place, unlil such lime as all of the <br /> necessary and required permits to conduct suct .vork are issued. <br /> 3. The Stelmakhs shali meet with the City of Everett Building Department to <br /> determine what options, if any, are available with the stru:.ture as constructed. I( <br /> thert are no onlions, the owners shall be required to bring the structure on-site <br /> into con(ormity with the R-2 zoning standards. <br /> 4. The Steimakhs shall be fined lhe sum of$1,000.00 per violatiun for a total of <br /> $2,000.00 for the violalion of the lack of a build�ng permit (or the construction and <br /> exceeding the height limit for the R-2 zone. Of lhis fine, �1,500.OU may be <br /> suspended upon the successful completien of item#5 below. The balance of the <br /> fine shall be paid to lhe Everett Ciry Cierk's Office, 2930 Welmore Avenue #1'10, <br /> Everett, Washington 98201 by December 31. 2009. <br /> 5. The Stelmakhs shdll apply and secure all necessary and required permits in <br /> order lo conducl and conclude the construclion aclivity and bring ihe residenlial <br /> structure at 10405 - 3rd Avenue SE, Everett, Washington into complele <br /> compliance with all ordinances o(the Everett Municipal Code and all City <br /> adopled conslruction standards. The City of Everett shali set time limits as to <br /> when the conslruclion shall be completed. If lhe work is not completed in a <br /> t:mely manner, the remaining portion of lhe s�spended fine, as listed in ilem#4 <br /> shall be immedialely due and paid in full at the Everelt City Clerk's Office. <br /> 6. If the Stelmakhs fail to abate the listed violalions, the Cily is authorized to <br /> undertake and complele lhe abalement in conformance with EMC 1.20. If the <br /> City is required lo do so, it shall be at the full expense of the owners. <br /> 7. Pursuant to EMC 1.20.040.F.10 jurisdictio� of this matter shall remain with the <br /> Hearing Examiner for period of two (2) years. <br /> 8. An appeal of this Order must comply with the procedures as sel fc,:i: in Chapter <br /> 36.70C of the Revised Code of Washinglon. <br /> 10 <br />
