Based upon the rmitten req�:est for a variance from the Ci�grN:� Y'lftt�A8o5&ia by: <br />Herbert J. 0'Bryant <br />10604 4th Dr. S.E. <br />Everett, NA 98204 <br />I hereinafter referred to as "Applicant," for a variance from E.M.C. <br />, 19.42.020(B), to allorr: construction of a 6 foot high fence on the south side <br />,I lot line that would be a minimum of nine feet tao and one-half inches from the <br />� prineipal structure on the adjoining property instead o? tt�e ten feet requir�d <br />by Code. <br />�I� on the foliowing described property <br />Lot 32, Plat of Cedar Lane <br />commonly Imorrr. ae: 10604 4Lh Dr. 3.6., Sverett <br />� The Board o; hdjustment� folloxing a public hearing on said application held <br />I on Septembev 8, 1986 and further having reviexed all testimony� makes the <br />folloxing Findings, Conclusions and Order: <br />1 FINDINGS AND CONCLUSIONS: <br />' 1. That there have been exceptianal or extraordinary circumstances or <br />iconditions applying to the subjeet property or as to the intended use <br />i thereof that do not apply generally to other properties in the same <br />! vicinity or zone. <br />Finding: The house on the adjoining lot to the south does not +it <br />squarely on the lot and sa the distance it is from the lot line va�a��s <br />from 9 feet 8.5 inches at the rear to 9 feet 2.5 inches on the front. <br />If the house was square on the lot, the Applicant xould be willing to <br />set• the fence in 3•5 innhes on his property in order to meat the 10 <br />Poot setback requlrement; however, he feels to set it in 9.5 inches on <br />his property would be excessive. <br />Conelusion: The variance as proposed by the Applicant appears to be a <br />reasonable request. <br />' 2. That such variance is necessary for the preservation and enjoyment of a <br />� substantial propecty right of the appellant possessed by the owners of <br />�, other proparties in the same vicinity or zone. <br />Findlna: Therc� does appear to be other fences in this area that do not <br />meet the requirement of being 10 feat from the principxl structure on <br />the adjoining lot. Since a permit is not required to put �:p a fenc^., <br />this may have occurred through lack of Imowledge of the Code. <br />Conclusion: Owners of other properties in the area have similar fences.� <br />
