Diedrich, applied to the City of Everett for <br />a Variance from the City of Everett Zoning Code Section 19.16.031 <br />which provides that "No lot shall be less ... than 7,500 sq. <br />feet in area for a two-family dwelling (duplex)". Defendant <br />requested the City of Everett, Board of Adjustment to "leave an <br />existing duplex that was built without proper permit on 6,000 <br />square foot lot. The minimum requirement for the 2oning Code <br />for duplex units is 7,500 square feet". (See City of Everett <br />Board of A��ustment Order dated October 10, 1983.) <br />VI. <br />That the application of Defendant, Dennis V. Diedrich, <br />was 3uly processed through the Administrative Departments of the <br />City of Everett and on or about October 10, 1983, the City of <br />Everett Board of Adjustments did conduct its public hearing and <br />enter its Oral Opinion granting said Variance. <br />VII. <br />The variance was granted apparently pursuant to Section f <br />of Ordinance No. 3572. This section is entitled "Jurisdiction - <br />Variances". The se.;tion states that a variance shall not be <br />granted unless the Board finds facts and conditions listed as a, <br />b, c and d exist. These are: <br />a. That there are exceptional or extraordinary circumstanc <br />�or conditions applying to the subject property or as to the <br />intended use thereof, that do not apply generally to other <br />properties in the same vicinity or zone. <br />b.
