City of Everett - Water Department APPLICATION FOR WATER All blanks must lie filled in or crosse,i out AGREEMENT THIS AGREEMENT, entered into this 18th day of March. 1925, between the Lowell Water District, a municipal cor- poration, pparty of the first part, and the City of S.rrett, a municipal corporation, party of the second port, WITNESSETH: WHEREAS, the party of the first part is a newly created water district for the purpose of furnishing a domestic water supply to the inlinbitailLs of that locality known as Lowell, immediately edjacent to the City- of Everett, on the South, and WHEREAS, said District has completed the construction of its main distribution system and is ready to begin fur- nishing water to is patrons, and, WHEREAS, the City of Everett is maintaining and operating a municipal water system, together with all of the necessary machinery and personnel for the same, said Everett Water System receiving its main water supply thru the Sul- tan pipe line from the Sultan ]liver, which pipe line runs thru the Lowell Water District nut from which line said district will receive its supply of center, and, WHEREAS, if the said District is compelled to create and set up the necessary machinery for conducting its own water system and to keep its own accounts, make its collections, and maintain and keep in repair its system of pipes, the sell[ systenn will be operated at it financial loss, and, WHEREAS, it will he for the interest of said Lowell Water District to make use of the said machinery and personnel of the Everett Water System for the oporation of the system of the District in conjunction therewith and the execution of this agreement will work to the mutual advantage of the City of Everett and the Lovell Water District, ,NOW, THERE- FORE, BE IT AGREED by and between the parties hereto as follows: 1.—The City of Everett is hereby named the agent of the Lowell Water District and said agent shall conduct, carry on, maintain and keep in repair mnl nnnke renewals to the entire wi,ler system of the Lowell Water District. It shall keep all the accounts of said District and matte all collections of water rates as hereinbefore provided. 2—The money received by the City of Everett from water rate collections shall be retained by said City and shall be accounted for ns follows: First: From said funds Everett shall meet nil of the operating ex lenses of said District, except for principal and m interest upon, and sinking funds for the retireent. of tiny bonds issued lenses the District. Second: A depreciation account shall be created amounting to five per cent (57) annually upon the capital invest. ment of the City of Everett with said Water District, which is hereby agreed to have n present value of $8600.00 and two per cent (2%) annually upon the capital investment of the Lowell Water District, which is hereby agreed to have a present value of $32,000.00. Said depreciation account to be used by the City of Everett for renewals and replacements of said water system. Third: That as compensation for its services as agent of the Lovell Water District in naintaining and conducting alibi water system the City of Everett shell have as its compensation as such agent, the earnings, if nay, of said Water District• uver and above said expenses of operation, maintenance and payments to be credited to the depreciation account. 3: It is agreed that the City of Everett shall keep a separate account of all moneys collerted from or expended with- in said Lowell Water District during the life of this agreement. 4: It is agreed that Everett shall be employed to make nil[ necessary service changes from the old Wood's Creek line and Everett distribution system to the now system of the District, the same to he paid for by the consumers. Likewise till new services in the future satill be connected by Everett and paid for in like manner by the consumers. 5: It is further agreed that nil services in the Lowell Water District shall be immediately metered at rates to be fixed by the Commissioners of the Lowell Water District. Such meters to be charged to eapilal outlay and paid for as such by the Water District. G: It is further agreed that the Lovell plater Distrirt shall levy, carp year, a sum equal to $2.00 per month for each fire hydrant located within said District, which sum shall be paid to the City of Everctt as a hydrant rental. in addition to other compensation to said City provided for herein. 7: The City cr Everett agrees to furnish surplus water to the Lovell Water District as long as this agreement re- nnnins in effect. 8: It is further agreed that all present property rights in said District of the parties hereto shall be retained. 9: It is further agreed that all extensions of mains within sold Lowell Water District shall be constructed and paid for by assessments upon abutting propo{y thru Loral Improvement Districts created by the Lowell Water District. 10: The life of this agreement shall be for fifty (50) years. Except as otherwise provided in this agreement• the rules, regulations and ordinances governing the Water Depart- nient of the City of Everett shall govern as to Lovell Water District consumers.
