, ,��iy <br />,/.- <br />SUMMARY <br />5217 South 2nd Street <br />OWN�R: Gerald Manley <br />On Afay 17, 1973 we received a memo from Fire Marshal Cooper which <br />listed deteriorated conditions at the Old Odd Fellows Hall in Lowell. <br />The property owner at that time was George Unsworth and our <br />negotiations with him, for the rehabilitation oi t:lie property, were <br />fru.itless. Durinq our struggle with him he sold the property to <br />Mr. Gerald Manley. <br />We notified Atr. Manley, by letter, of several violations of the <br />Uuilding code on March 26, 1979. There was no response to this <br />letter. On April B, 19'i4, we issued a notice of unsafe building, <br />which was mail�d to Mr. Manley by certified letter. Mr Manley <br />received this notice on April 10, 1974. <br />On April 18, 1974, Afr. bfanley telephoned us and stated that he had <br />plans to repair the building and he requested thirty (30) days <br />extension to effect this. <br />On June 17, 1979, after we noticed that the property had further <br />deteriorated, we mailed notice to P4r.. hlanley of a Building Officials <br />liearing, which was held on July 16, 1974. As Mr. Manley did not <br />attend the hearing, the 13uilding Official ordered a re-inspection <br />of the structure. This inspection was completed on July 30, 1979, <br />and Mr. Manley was made aware of the violations, by letrer, on <br />elugust 12, 1974. Mr. Manley did not resoond to this letter. <br />A second Buildiag Officials IIearing was held on September 17, 1979. <br />P1r.. Manl.ey was present and agreed, at that time, to immediately <br />correct the dan��erous conditions on the outside of the building and <br />to obtain the ne�essary permits to begin rehabilitation of the <br />structure before January 1, 1975. <br />On December 2, 1974, ;,e noticed that Mr. Manley had not kept hi, <br />agreement to correct the outside violations. He was notified of <br />this by telephone and hc promised to have D1r. Perguson, a contractor, <br />take care of the matter. <br />The Tenant, who had occupied the apartment at the rear of tlte <br />building duri.ng these preceedings, moved out on or before December <br />17, 1974. The water service to the structure was interupted at this <br />time to preclude vandalism. Mr. Manley was notified of this action <br />on December 18, 1979. <br />On January 6, 1975, �ve found ihe structure open and unattended. <br />There was evid�nce of vandalism and transient use of the building. <br />I9e mailed notice of a council presentation to Mr. Manley on <br />January 13, 1975, and as we did not receive a return card, we <br />delivered a copy of the notice to his ad�ress where it was accepted <br />by Mrs. Manley oh January 21, 1975. <br />
