r u 'd f- i-� -", City of Everett --Water Department APPLICATION FOR WATER All blanks must be filled in or crossed out AGREEMENT THIS AGREEMENT, enterc.l into this lgth tiny of lurch, 1925, between the Lowell Water District, a municipal cor- poratian, party of the first Part, ..nil the City of Everett, a municipal corporation, party of the second part, WITNESSETH: WHEREAS, the party of the first part is a newly created water district for the purpose of furnishing a domestic water supply to the inhabitants of that locality known as Lowell, inmledintely adjacent to the City of Isverett, all the South, and 1l'III3REA5, said District has completed the construction of its main distribution system and is ready to begin ur- nishing water to its patrons. and, all WHEREAS, the City of Everett is maintaining and operating a municipal water system, together il`t�lhrulltl of Sul- tan machinery and personnel for the same, said Everett Water System receiving its main 4vater supl tan pipe line from the Sultan River, which) pipe line runs thru the Lowell Water District and front which line said district will receive its supply of water, and, WHEREAS, if ilia said District ithe necessary machinery for s compelled to creole and set up conducting its earn water system and to keep its own accounts, make its collections, and maintain and keep in repair its system of pipes• the said F4'alalll \4'III he operated at a fi: nncinl loss, and, WHEREAS, it will be for the interest o[ said Lo44•ull Water District to oaks use of the said nuwhino•y and personnel Of the Everett Water System for the operation of the system of the District in conjunction therewith and the execution of this agreement will work to the mutual advantage of the City of Everett and the Lowell Water District, NOW, THERE- FORE' BE 1T AGREED by and bet -mot the parties hereto its follows: 1.—The City of Everett is hereby an med the agent of the Lowell 1Vnler District and said agent shall conduct, carry on, maintain and keep in repair and make renewals to the entire water system of the Lowell Witter District. It shall keep all the accounts of said District and make all collections of water rates as hereinbefore provided. 2—The money received by the City of Everett from water rate collections shall be retained by said City and shall be accounted for as follows: first: From said Prods Everett shall meet nil of the operating expenses of said District, except for principal and interest upon, and sinking funds for the retirement of any bonds issued by the District. Second: A de )reciation account shall be created amounting to five per cent (57c) annually upon the capital invest - Second: of the City of );veeU with said Water District, which is hereby agreed to have n present value of $Sfi00.00 and two per cent (2 �) nnnunlly upon the capital investment of the Lowell Water District, which is hereby agreed to have a present value of $32,000.00. Said depreciation account to be used by the City of Everett for renewals and replacements of satd water system. Third: That as compensation far its services its agent of the L,w•ell Water District in maintaining and conducting said water system the City of Everett shall have as its compensation aj such agent, the enevings, if any, of said Water Uistrict, over and above said expenses of operation• maintenance anti payments to be credited to the depreciation account. 3: It is agreed that the City of Everett shall keep a separate account of all moneys collected front or expended with- in said Lowell Water District during the life of this agreement. 4: It is agreed that Everett shall be employed to mike all necessary service chnnges front the old Wood's Creek line and Everett distribution system to the new system of the District, the same to be paid for by the consumers. Likewise all new services in the future shall be connected by Everett and paid for in like innmur by the consumers. li: It is further agreed that all services in the Lowell Witter District shall be immediately metered at rates to be fixed by the Commissioners of the Lowell Water District. Such meters to be charged to capital outlay and paid for as such by the Water District. 6: It is further agreed that the Lowell Water District shall levy, each year, n sum equal to $2.00 per month for each fire hydrant located within said District• which sum shall be paid to the City of Everett its a hydrant rental, in addition to other compensation to said City provided for herein. 7: The City of Everett ngrees to furnish surplus water to the Lowell Water District as long its this agreementre- mnins in effect. 8: It is further agreed that all present property rights in said District of the parties hereto shall be retrained. 9: It is further agreed that all extensions of mains within said Lowell Water District shall be constructed and paid for by assessments upon abutting property thru Local Improvement Districts created by the "well Water District. 10: The life of this ngreement shall be for fifty (60) years. Exceptits otherwise provided in this agreement, the rules, regulations and ordim.nces governing the Water Depart. ment of the City of Everett shall govern as to Lowell Wider District consumers.
