Photo of Fletcher Residence at 4223 S 3rd <br />It was determined and decided by the Hearing Examiner that the entire recora of this <br />proceeding, including all the exhibits from the previous two Hearing Examiner hearings, <br />are part or the official record. <br />All of the exhibits are available for inspection at the hL_. ig Examiner's Office located at <br />2930 Wetmore Avenue, 8th floor, Everett, Washington. <br />After due consideration of the testimony and evidence presented by the Applicant, <br />testimony and evidence elicited during the public hearings, and as the result of the <br />personal inspection of the subject properly and surrounding areas by the Everett Hearing <br />Examiner, the following findings of fact and conclusions constitute the basis of the decision <br />of the Everett Hearing Examiner. <br />Craig VanSant (hereinafter referred to as Applicant) requested approval from the <br />City of Everett for a Non -Conforming Use Permit for property located at 4228 South <br />Third, Everett, Washington. The Non -Conforming Use Permit was requested for <br />commercial and multi -family use on the property. it was the intent of the Applicant <br />to use the property as an automobile detailing facility on the main floor of the <br />building and multi -family living units on the second floor of thfe property. <br />The Washington Court of Appeals upheld the City of Everett Hearing Examiner's <br />reversal of the certification of non -conforming use for the muili-family use on the <br />subject property. This portion of the nonconforming use is not an issue in this <br />proceeding. <br />
