Based upon the preceding findings of fads and conclusions, testimony and evidence submitted at the pubic hearing, upon the impressions of the Hearing Examiner of a site view, and based on the record of all the hearings held by the Hearing Examiner of «; City of Everett on this matter and the Court of Appeals of the State of Washington decision in file 028049-0-I, it is hereby ordered that the Everett Dir KIor of Planning and Community Development's issuance of a Non -Conforming Use Permit for property of 4228 South Third Everett, Washington for a nonconforming commercial use on the main floor of said building is hereby affirmed and the Non -Conforming Use Permit is granted. The Non - Conforming Use Permit as issued by the Everett Director of Planning and Community Development for the multi -family use at the same property is hereby reversed.
