<br />AGREEMENT
<br />THIS AGREEMENT, entered into this 18th day of blurch, 1925, between the Lowell Water District, a municipal cor-
<br />poration, pparty of the first part, nod the City, of Everett, a municipal corporation, pnrty of the second part, WITNESSETH:
<br />WIIER 'AS, the party of the first part is a newly created water district for the purpose of furnishing a domestic
<br />water supply to the inhabitants of that locality known as Lowell, immediately adjacent to the City of Everett, on the South,
<br />and
<br />WHEREAS, said District has completed the construction of its main distribution system and is ready to begin fur-

<br />EAS, the City of Everett is maintaining and operating a municipal water system, together with all of the
<br />necessary machinery and personnel for the same, said Everett Water System receiving its main water supply thru the Sul-
<br />tan pipe line from the Sultan River which pipe line runs thru the Lowell Water District and from which line said district
<br />will receive its supply of water, and,
<br />WHEREAS, if the said District is compelled to create and act up the necessary machinery for conducting its own
<br />water system and to keep its own accounts, make its collections, and maintain and keep in repair its system of pipes, the
<br />said system will be operated at a financial loss, and,
<br />WHEREAS, it will be for the interest of said Lowell Water District to make use of the sold machinery and personnel
<br />of the Everett Water Svstem for the operation of the system of the District in conjunction therewith and the execution of
<br />this agreement will wail, to the mutual advantage of the City of Everett and the Lowell Water District, NOW, THERE-
<br />FORE,
<br />BE IT AGREED by and between the potties hereto as follows:
<br />1. The City of Everett is hereby named the agent of the Lowell Water District and said spent shall conduct, entry
<br />on, maintain and keep in repair and make renewals to the entire water system of the Lowell Water District. It shall keep
<br />all the accounts of said District and make all collections of wr.'er rates as hereinbefore provided.
<br />2.—The money received by the City of Everett from wader rate collections shall be retained by sold City and shall be
<br />accounted for as follows:
<br />First: From sold funds Everett shnil meet all of the operating expenses of said District, except for principal and
<br />interest upon, and sinking funds for the retirement of any bonds issued by the District.
<br />Second: A deprecation account shall be created emanating to five per cent (670) annually upon the capital invest-
<br />ment of the City of Everett with said Water District, which is hereby ngreecl to have a present value of $8600.00 and two
<br />per cent (27e) annually upon the capital investment of the Lowell Water District, which as hereby agreed to have a present
<br />value of $32,000.00. Said deprecintion account to be used by the City of Everett for renewals anti replacements of said water
<br />system.
<br />Third: Tint as compensntion for its servhrs as agent of the Lowell Water District in maintaining and conducting
<br />said water system the City of Everett shrill have as its compensation as such agent, the earnings, if any, of said Water
<br />District, over and above said expenses of operation, maintenance end payments to be credited to the depreciation account.
<br />3: It is agreed that the City of Everett shall keep a separate account of all moneys collected from or expended with-
<br />in said Lowell Witter District during the life of this agreement.
<br />4: It is agreed that Everett shall be employed to make all necessary service changes from the old Wcod's Creek line
<br />and Everett distribution system to the now system of the District, the same to be paid for by the consumers. Likewise all
<br />new services in the future shall be. connected by Everett and paid for in like manner by the consumers.
<br />6: It is further agreed that all services in the Lowell Water District shall be immediately metered nt rates to be
<br />fixed by the Commissioners of the Lowell Water District. Such meters to be charged to capital outlay and paid for as such
<br />by the Water District.
<br />6: It is further agreed that the Lowell Water District shall levy, each year, a sum egdal to $2.00 per month for
<br />each fire hydrant located within said District, which sum shall be paid to the City of Everett as a hydrant rental, in addition
<br />to other compensation to said City provided for herein.
<br />7: The City of Everett agrees to furnish surplus water to the Lovell Water District as long as this agreement re.
<br />mains in effect.
<br />8: It is further agreed that till presentproperly rights in said District of the parties hereto shall be retained. _..
<br />9: It is further agreed that all extensions of mains within said Lowell Witter District shall be constructed and Rlid
<br />for by assessments upon abutting property thru Local Improvement Districts created by the Lowell Water District.
<br />10: The life of this agreement shall be for fifty (60) years.
<br />Except as otherwise provided in this dgreenmntn the rules, regulations and ordint.nces governing the Water Depart-
<br />ment of the City of Everett shall govern as to Lowell Water District consumers.

<br />I hereby apply for the use of water in necordnnee with the rules and regulations of the City of Everett Water De-
<br />partment, for the Purposes and fixtures stated below.
<br />During the time that tiny of the water mains may be token up by reason of tiny improvements authorized by the City
<br />of Everett or the Lovell Water District, in or on any street or alley In which they may have been laid, the City Water De-
<br />partwentwill not he reouired to furnish water during the progress of such Improvements to any consumer whose supply mny
<br />thus be cut off, orbeliable for any damages for its failure so to do.

<br />I have read the copy of the contract between the City of Everett and the Lowell Water District hereto attached and
<br />which contract is a part of this Application Agreement and 1, as applicant, thereby agree to be �bound
<br />by the terms hereof.
