City of Everett - Water Department APPLICATION FOR WATER All blanket must be filled in or crossed out AGREEMENT THIS AGREEMENT, entered into this lSth day of March, 1925, between the Lowell Water District, a municipal cor- poration, party of the first part, and the City of Everett, a municipal corporation, Party ,f the second part, WITNESSETH- WHEREAS, the party of the first part is ¢ newly created water district for the Purpose of furnishing a domesr:,. water supply to the inhabitants of that locality known as Lowell, immediately adjacent to the City of Everett, on the Sou J. and WHEREAS, said District has completed the construction of its main distribution system and is ready to begin fur- nishing water to its patrons, and, WHEREAS. the City of Everett is maintaining and operating a municipal water system, together with all of the necessary machinery and personnel for the same, said Everett Water System receiving its main water supply thru the Sul- tan pipe line from the Sultan River, •r'hich pipe line runs thru the Lowell Water District and from which line said district will receive its supply of water, ands WHEREAS, ithe said Dist•cl is compelled to create and set up the necessary machinery for conducting its own water system and to keep its own accounts, make its collections, and maintain and keep in repair its system of pipes, the said syst_m will be operated at a financial loss, and, WHEREAS, it will be for the interest of said Lowell Water District to make use of the amid machinery and personnel of the Everett Water System for the -operation of the system of the District in conjunction therewith and t e execution of this agreement will work to the mutual advantage of the City of Everett and the Lowell Water District, NOW, THERE. FORi:, BE IT AGREED by and bctw•ecn the Parties hcreW ns follows: 1.—The City of Everett is herby named the agent of the Lowell Water District and said agent shag conduct, carry on, maintain and keep in repair and Make renewals to the entire water system of Lhe Lowell R'nter District It shall keep all the accounts of said District and make all collections of water rates as hereinbetore provided. 2.—The money receired by the City of Everett from water rate collections shell be retained by said City and zhall be mccount..d for ns follows: First: From avid funds Everett shall meet all o[ the operating exppeases of said District, except for principal and interest upon, and sinking funds for lire retirement of any bonds issued by the District. Second: .\ depreciation account shall be created amounting Lo five per cent (65b) annually upon the capital invest- met value of to have 00 and two PC r cent (2'ir) nnnuallPv upon the capitol investment of the Lowell \Valor District, which rs het•eby agreed to have n present value of $32,000.00. S id depreciation account to be used by the City of Everett for renewals end rep ncements of said water system. Third: That as compensation for its services ns agent of the Lowell Water District in maintaining and conducting said water system the City of Everett shall have as its compensation as such agent, the earnings, if any, of said Water District• over nnJ above said expenses of operation, maintenance and payments to be credited to the depreciation account. 3: It is agreed that the City of Everett slmll keep n separate account of all moneys collected from or cxpended with. in said Lowell Water District during the life ct this agreement. 9: It is agreed that Everett shall be employed to make all necessary service changes from the old Wood's Creek line and Everett distribution system to the now system of the District, the same to be paid for by the consumers. Likewise all new services in the future anall be connected by Everett and Paid for in like manner by the consumers. 6: It is further agreed that all services in the Lowell Inter District shall be immediately metered at rates to be fixed by the Commission^rs of the Lowell Water District. Such meters to be charged to capital outlay and paid for na such by the Water District. 6: It is further agreed that the Lowell Water District shall levy, each year, a sum equal to $2.00 per month for ench fire hydrant located within said District, which sum shall be paid to the City of Everett ns a hydrant rental, in addition to other eempersntion to said City provided for herein. 7: The City of Everett agrees to furnish surplus water to the Lowell Water District as long as this agreement re- mains in effect. 8: It is further agreed that all present property rights in said District of the Parties hereto shall he retained. 9: It is further agreed that PIT extensions of m:ens within sold Lowell Wider District shall be constmeted and paid for by assessments upon abutting property thru Local Iraprmement Districts created by the Lowell water District. 10: The life of this ngreePeent shall be for fifty (69) years. Except as othenvise provided in this agreement• the rules, regulations and ordinances governing the water Depart- ment of the City of Fveiett shall govern m.. to Lowell Water District consumers. During the time that any of the water mains may be taken up by reason of any improvements authorized by the City of Everett or the Lowell water District, in or on any street or alley in which they may have been laid, the City Water De- partment will not be renuired to furnish water during the progress of such improvements to any consumer whose supply may thus be cut off, or be liable for any damages for its failure no to do.
