(EBective unfil January 1, 2013.) <br />(1) Any person who violales any provision of this chapter nol amounting to a violalion of RCW 19.122.055, and which violalion <br />resulls in damage lo underground faciiities, is subjed la a civil penaity of nol more than one thousand dollars ior each <br />violation. All penalties recovered in such adions shali be deposited in the general fund. <br />(2) Any excavalor who willfully or maliciously damages a field•marked undergraund facility shail be liable for treble the cosls <br />incurred in repairing or relocating the faciliry. In those cases in whi:h an excavatar fails to notify known underground faciiiry <br />owners or ihe one-number locator service, any damage to ihe und. rground tacility shall be deemed willful and maiiaous and <br />shall be subjecl to treble damages for costs inwrred in repairing or r,�locating lhe facility. <br />(3) This chapter does not affecl any civil remedies tor personal injuri or for property damage, including thal to underground <br />facilities, nor does this chapter create any new civil remedies for such damage. <br />�2005 c 448 § 4; 1984 c 144 § 7.) <br />NoteS: <br />Damages to facilities on state highways: RCW 47.44.1 F0. <br />RCW 19.122.070 <br />Civil penalties —Trehle damages — Existing remedies nol aHecled. (Eflective January 1. 2013.) <br />(1) Any person who violates any provision of lhis chapter not amounting to a violation of RCW 19.122.055 is subjed to a civil <br />penalty of not more than one thousand dollars Tor an initial violation, and not more than five thousand dollars for each <br />subsequent vioiation wilhin a three-year period. All penalties recovered in such actians musl be deposited in the damage <br />prevention account created in RCW 19.122.160. <br />(2) Any excavator who willfully or maliciously damages a marked underground faciiity is liable for treble the costs incurted <br />in repairing or relocating the facility.
