(1) Any person who violales any provision of this chapter nol amounting to a violalion of RCW 19.122.055, and which violalion resulls in damage lo underground faciiities, is subjed la a civil penaity of nol more than one thousand dollars ior each violation. All penalties recovered in such adions shali be deposited in the general fund. (2) Any excavalor who willfully or maliciously damages a field•marked undergraund facility shail be liable for treble the cosls incurred in repairing or relocating the faciliry. In those cases in whi:h an excavatar fails to notify known underground faciiiry owners or ihe one-number locator service, any damage to ihe und. rground tacility shall be deemed willful and maiiaous and shall be subjecl to treble damages for costs inwrred in repairing or r,�locating lhe facility. All penalties recovered in such actians musl be deposited in the damage prevention account created in RCW 19.122.160. (2) Any excavator who willfully or maliciously damages a marked underground faciiity is liable for treble the costs incurted in repairing or relocating the facility. In lhose cases in which an excavator fails to notify known facility operators or a one- number localor service, any damage to the underground facilily is deemed willful and malicious and is subjecl lo treble damages for costs incurted in repainng or relocaling Ihe facility. (3) This chapler does not affect any civil remedies for personal injury or for property damage, including lhat to underground facilities, nor does lhis chapter create any new civil remedies tor such damage.
