. �i . ,� . <br />, .., � <br />�.� <br />POWER OF ATTORNEY <br />�a��. �,-a s.3'=`°�i_ <br />WHEREAS, Ordinance No. 555-78 was enacted to reduce the adverse effect <br />of increased vehic:le and pedestrian traffic on existing neighborhoods and <br />provide safe and ��fficient facilities for vehicle and pedestrian traffic; and <br />WHEREAS, Ordinance No. 555-78 requires, in part, a developer to improve <br />street and alley rights-of-way; or at the discretion of the City Engineer, a <br />developer may convey and execute in the favor of the City of Everett an <br />irrevocable power of attorney for the sole purpose of casting a vote, signing <br />a petition or othezwise assentinq to the formation of a Local Improvement <br />� District. � <br />NOW, THEREFORE, in consideration of issuance of a building permit, <br />pursuant to Ord.inance No. 555-78 and in lieu of certain required street and/or <br />alley improvements, <br />reterred to as "Developer"), and pursuant to Ordinance No. 555-78, has made, <br />constituted and.appointed and by these presents does make, constitute and <br />appoint the City as true and lawful attorney for it and in its name, place <br />an3 stead, and as an irrevocable proxy to cast a vote for approval, by <br />petition or othenaise. of any Local Impmvement District hereafter £ormed by <br />the City, its successor or other property owners in � benefit area encompassing <br />, .. <br />for ultimate street and related improvements pursuant to Ordinance No. 555-78, <br />as it presently exists or is hereafter amended or supplanted. <br />This power of attorney shall be a conveyance of an irrevocable interest <br />in and the Developer does by these presents convey to the City such limited <br />uiterest in cne following described land, to wit: <br />This power of attorney shall be a covenant to run with the fee title <br />to the above-3escribed land perpetuali.y; PROVIDED: The City of Everett shall <br />deliver a signed release of this power of attorney after installation of the <br />ultimate improvements shall have been completed. <br />IN TIITNESS WHEREOF, the Developer has hereunto set its hand and seals <br />this day of , 1979. <br />STATE OP S9ASHINGTON ) <br />) ss. <br />C'ounty of ) <br />On this day personally appeared Sefore me <br />, to i <br />mc known to be the individual described in and who executed the within and <br />foregoiug instrument and ac}:nowledged that he/tliey si9ned tNe same as hic/their <br />free and voluntary act and deed for the uses and puiposes cherein mentioned. ; <br />1979. <br />GIVEN under my hand and official seal this day of <br />NOTARY PU3iIC in and for tlie State <br />of Washington, residing at <br />`� <br />
