p/L/ LYO/'K
November 7, 1996
Carolyn deLambert
5607 SoutF 3rd Avenue
Everett WA 98203
Subject: New Residential Development
Dear Mrs. deLambert:
The purpose of this letter is to summarize our recent site discussions concerning access and
drainage associated with the recent residential constniction in your neighborhood. The following
is my understanding of those discussions:
It appears that the additional drainage that flows onto the street from the new yard
areas, driveways, etc. can be adequately handlcd by the existing street storm system.
The recent repair of the asphalt curb and installation of new berming around the catch
basin should address your concerns. Additionally, we have directed the developer to
provide erosion control measures to thc yard azeas until the grass begins to adequately
contain the runoff.
' Historically, you have gained access to a portion of the unimproved 3rd Avenue right
of way and property that you own south of the new horr.es via a gated drive that now
abuts the southerly new home, 5610 South 3rd Avenue. The drive can be described as
generally being located within the public right of way, following a southerly direction,
paralleling the west side of the asphalt public street, and crossing over what would
appear to be a portion of the front yard of the new home. I have reviewed the
situation with the builder who acknowledges your access as long as the drive is not
used to park vehicles. Likewise, the drive should not be used by residences of the new
home for parking vehicles. Should the public have a future r.eed for the unused right
of way, you would be required to remove any temporary facilities and/or access and
generally cease use of the right ef way as required by code.
I understand your belief that it doesn't seem fair tliat you should have to limit your use of right
of way that you have used and maintained for all of these years.
CITY OF EVERETT• 3200 Cedar Street • Everett, WA ggzp •(206) 259-8A00 • Fax (206) 25P-8856
