1. Grant of Easement to Kenna. Anderson hereby grants to <br />Kenna for the benefit of Parcel B, a non-exclusive perpetual <br />easement for drainage over, under and across a 5 foot strip of land <br />lying adjacent to and southerly and westerly of the following <br />described line: <br />Commencing at the Northeast corner of Lot 3 of that short <br />subdivision as recorded in Volume 2988, pag:s 1546 and <br />1553, records of Snohomish County, Washington, said <br />corner being N 18°33'28" E a distance of 17.71 feet from <br />the East-West centerline of Section 5, Township 28 Nor�h, <br />Range 5 East, W.M.; thence N 18°33'28" E, al�ng the East <br />line of Lot 2 of said short subdivis.ion, a distance of <br />5.41 feet to the True Point of Beginning of herein <br />described line; thence S 86°11'S6" E a distance of 5.17 <br />feet; thence S 18°33'28" W, parallel with the East lines <br />of Lots 2 and 3 of said short subdivision, a distance of <br />17.84 feet; thence S 86°11'56" E parallel with the East- <br />West centerline a distance of 200 feet, of Section 5, <br />Township 28 North, Range 5 East, W.M. <br />together with the right to construct, improve, maintain and re�air <br />a subsurface drain pipe within said easement area. <br />2. Grant of Easement to Anderson. Kenna hereby grante to <br />Anderson for the benefit of Parcel A, a non-exclusive perpetual <br />easement for utilities over, under and across that portion of <br />Parcel B legally described as follows: <br />The north 5 feet of Lot 2 City of Everett Short Plat <br />Number 6-94 recorded under Recording Number 9412210240, <br />being a portion of t�te southwest quarter of the northea�t <br />quarter and the northwest quarter cf the southeast <br />quar�er of Section 5, Township 28 North, Range 5 East, <br />W.M., in Snohomish County, Washington. <br />together with the right to install, maintain and repair suUsurface <br />utilities within said easement area. <br />3. Iniunctive Relief. In the event of any violation or <br />threatened violation by any owner, occt•pant, or lessee of Parcels <br />A or B or any portion thereof, of the terms of this Agreement, any <br />other owner, occupant or lessee of the other parcel or any portion <br />thereof shall be entitled to an injunction restrainina any further <br />violation or threatened violation of this Agreement (withouC any <br />bond or other security being required) or any other appropriate <br />degree oi specific performance, cvithout showing any actual dan,age <br />or that monetary damages would not provide an adequate remedy. <br />Such remedy shall not be exclusive and stiall be in addition to any <br />other remedy which the nen-breaching party may have, including, <br />without limitation, the right lo moneL-ary damage for the period <br />preceding such enforcement. <br />EASEMENT AGREEMENT - 3 <br />nI'9��fA ('eD� �.+� L <br />
