<br />AGREEMENT
<br />THIS AGLEEMENT, entered into this 181h day of March, 1925, between the Lowell Water District, n municipal cor-
<br />poration, party of the first part, and the City of Everett, a municipal corporation, party of the second part, WITNESSETH:
<br />WHEREAS, the party of the first part is a newly created water district for the purpose of furnishing a domestic
<br />water supply to lho inhabitants of that locality known as Lowell, immediately rdjacent to the City of Everett, on the South,
<br />and
<br />WHEREAS, said District has completed the construction of its main distribution system and is ready to begin fur-
<br />nis:, ng water to its patrons, and,
<br />WHEREAS, the City, of Everett is maintaining mid operating n municipal water system, together with all of the
<br />necessary machinery and personnel for the same, said Everett Water System receiving its main water supply thru the Sul.
<br />tan pipe line front the Sultan River, which pipe line runs thru the Linvell Water District and from which line said district
<br />will receive its supply of water, and,
<br />WHEREAS, if the said District is compelled to create and act up th- necessary machinery for conducting its own
<br />water system mud to keep its own accounts, make its collections, and maintain and keep in repair its system of pipes, the
<br />said system will be operated at a financial loss, and,
<br />WHEREAS, it will be for the interest of said Lowell Water Distract to make use of the said nmchinery anti personnelof the Everett Water System for the operation of the system of the District in conjunction therewith and the execution of
<br />this agreement will work to the mutual advnntnge of the City of Everett and the Lowell Water District, NOW, THERE-
<br />FORE'BE IT AGREED by and betw•ec❑ the parties hereto as follows:
<br />L—The City of Everett is hereby named the agent of the Lowell Water District and said agent shall conduct, carry
<br />oil, maintain and beep in repair and make renewals to the entire water system of the Lowell Water District. It shall keep
<br />all the accounts of said District and make all collections of water rates as hereinbefore provided.
<br />2.—The money received by the City of Everett from water rate collections shall be retained by said City and shall be
<br />accounted for as follows:
<br />First: From said funds Everett shall meet all of the operating expenses of said District• except for principal and
<br />interest upon, and sinking funds for the retirement of tiny bonds issued by the District.
<br />Second: A deveciation account shall be created amounting to five per cent (5%r) annually upon the capital invest-
<br />ment of the City of Everett with said Water District, which is hereby agreed to have a present value of $8600.00 mid two
<br />per cent (2%) annually upon the capital investment of the Lowell Water District, which is hereby agreed to have n present
<br />value of $32,000.00. Said depreciation account to be used by the City of Everett for renewals and replacements of said water
<br />system.
<br />Third: That as compensation for its services as agent of the Lowell Water District in maintaining and conducting
<br />snid water system the City of Everett shall have as its compensation as such agent, the earnings, it any, of said Water
<br />District, over and above said expenses of operation, maintenance and payments to be credited to the depreciation account.
<br />3: It is agreed that the City of Everett shall keep a separate account of all moneys collected from or expended with.
<br />in said Lowell Water District during the life of this agreement.
<br />4: It is nuced that Everett shall be emphiled to nmke all necessary service changes from the old Wood's Creek line
<br />and Everett distribution system to the new system f the District, the some to be paid for by the consumers. Likewise all
<br />new services in the future still)] be connected by 'verett and paid for in like manner by the consumers.
<br />5: It is further agreed that all services in the Lowell Water District shall be immediately metered at rates to be
<br />fixed by the Commissioners of the Lowell Water District. Such meters to be charged to capital outlay and paid for as such
<br />by the Water District.
<br />0: It is further agreed that the Lovell Water District shail lay, each year, a sum equal to $2.00 per month for
<br />each fire hydrant located within said District, which sum shall be paid to the City of Everett an P. my�rant rental, in addition
<br />to other compensation to said City provided for herein.
<br />7: The City of Everett agrees to furnish surplus water to the Lovell Water District as long as this agreement re-
<br />mains in effect.
<br />8: It is further agreed thnt all present property rights in snid District of the pnrties hereto shall be retained.
<br />9: It is further agreed that all extensions of mains within sold Lowell Water District shall be constructed and paid
<br />re' by assessments upon abutting property thru Local Improvement Districts created by the Lowell Witter District.
<br />10: The life of this agreement shill be for fitly (50) years.
<br />Except as otherwise provided in this agreement, the rules, regulations and ordinances governing the Water Depnrt-
<br />ulent of the City of Everett shall govern its to Lowell Winter District consumers.

<br />During the t.sie that any of the water mains may be taken up by reason of any improvements authorized by the City
<br />of Everett or the Lin ell Rater District, in or on any street or alley in which they may have been laid, the City Water De-
<br />partment will not be required to furnish water during the progress of such improvements to any consumer whose supply may
<br />thus be cut off, or be limitable for any dntnnges for its failure so to do.
