Fourth <br />Everett, WA 98203 <br />hereinafter referred to as �'Applicant,�� for a var.iance from <br />E.M.C. 19.16.040 (B), Lnt Coverage for Accessory Buildings and <br />E.M..C. 19.42.040 (Al, Side Yards for Corner Lots to allow an ad- <br />dition to an existing garage for a total size of 650 square <br />feet. The lot coverage would exceed the G00 square feet allowed <br />by code and the corner side lot would be four feet instead of <br />the ten feet required by code. <br />On the following described property: Lot 31 and 32, Block 6, <br />Plat of Lowell, Div. C <br />Commonly known as: 4401 S. Fourth <br />The Board of Adjustment, following a public hearing on said ap- <br />plication held on July lo, 1989, and further having reviewed all <br />testimony, makes the following Findings, Conclusions and order: <br />F�NDrNGS AND ON r rt�rnrrc <br />Cri_t �on No t• <br />That there have been exceptional or extraordinary circumstances <br />or conditions applying to the subject property or as to the in- <br />tended use thereof that do not apply generally to other proper- <br />ties in the same vicinity or zone. <br />a. F;nd�nu: The property consists of a 50 foot by 12o foot <br />lot with an existinq single family structure, <br />woodshed, storage shed, and garage. The single <br />family structure has been improved and is in <br />good condition, while the accessory structures <br />still need improvement. The Applicant has be- <br />gun reconstruction of the garage and has in- <br />creased the size by three feet six inches on <br />the west and three feet on the south. The con- <br />struction was started without obtaining build- <br />ing permits, and a Stop Work order was issued <br />after the foundation and the roof trusses were <br />in place. <br />Previous to the new construction, the old ga- <br />rage was nonconforming for side setback, since <br />it had only a four foot setback adjacent to <br />44th Street instead of the required ten foot <br />side setback for corner lots. Lot coverage al- <br />lowed for accessory buildings was also noncon- <br />forming since the total area covered by the ga- <br />rage, woodshed and storage shed was 511 square <br />feet instead of the 600 square feet allowed by <br />code. <br />The existing side setback nonconformity would <br />be extended four feet further to the west which <br />is a minor extensiun of an existinq nonconfor- <br />mity. <br />
