4. An environmentally sensitive area protective covenant for each parcel must be submitted <br />to the Planning Department for review and approval prior to issuance of any <br />development permits for a site or sites where the TOR credits are to be applied. The <br />covenants must be recorded on the title of each lot and must sever the development <br />rights for each parcel of the subject property consistent with the provisions of EMC <br />Chapter 19.37.050.6.3.c. The covenants must have a legal description for the entire lot <br />and restricted areas, and must have a parcel map attached. <br />5. The soils study must be amended to address specific recommendations for grading, <br />foundation design, and drainage measures. The soils engineer must make inspections <br />during key phases of construction. <br />6. Prior to issuance of a building permit for the duplex Parcel 3-027, the applicant must <br />prepare a covenant running with the land which waives claims against the City, Its <br />officers, employees and agents, and indemnifies (including reasonable attorney's fees), <br />defends and saves the City, its officers, employees and agents harmless from any loss <br />or damage to people or property either on or off the subject property resulting from any <br />form of soil movement whatsoever and/or from any form of failure in design and/or <br />construction of the improvements thereon whatsoever. The owners of subject property <br />shall provide the City with the covenant and it shall be signed and acknowledged by all <br />parties with an interest in the property. The covenant shall also provide notice <br />concerning the presence of environmentally sensitive features on the property. The <br />covenant must be presented to the City Attorney for review and approval and, upon <br />approval, recorded by the applicant with the Snohomish County Auditor prior to issuance <br />of any construction permits. Please note that a standard form is available from the City. <br />Public Works Requirements: <br />A Public Works Permit is required for this project. Detailed drawings in accordance with <br />City Design and Construction Standards shall be submitted to the Public Works <br />Department, showing site parking layout, landscaping, utilities, storm drainage, <br />temporary construction erosion control, and all required improvements in the public <br />right-of-way. Public Works Department approval of these drawings is required prior to <br />any permits being issued. All Improvements shall be completed, approved and <br />warranted before the Occupancy Permit is issued/final approval is granted. <br />2. Parking must be per City Zoning Code and City Design and Construction Standards for <br />Development. <br />3. In accordance with the City of Everett Traffic Mitigation Ordinance, a Traffic Mitigation <br />fee of $1,800.00 is required to be paid prior to the issuance of building permits. <br />4. Any grading/fill on this site shall be done so as to not impact the surrounding properties. <br />5. This project must comply with the current City of Everett Building Code and Sprinkler <br />Ordinance. <br />6. Lack of comment on the plans submitted with the application does not constitute <br />approval of these plans <br />7.
