Six months have elapsed since the water line broke and the embankment <br />washed away. This rtiatter is carrying on for a considerable length of time. it <br />appears to be in the best interest of both parties to get this matter resolved as soon <br />as is possible or, at least, reach an agreeme�it as to the course of action which will <br />be taken. <br />We have discussed the pussibility of dividing the costs based upon an estimatiun of <br />liability. It was my initial feeling that the City would be willing to absorb one- <br />third of the total cost if you would provide the balance. <br />In appreciation of your position, as well as the need to get this matter resolved,l <br />feel that if you were willing to accept responsibility fcr one-half of the total costs <br />incurred by the City, that the City would be agreeable to settiing this matter. In <br />my !etter to you dated 7anuary 30, 1980, 1 represented that the total cost was <br />$4,320.31. This figure included an estimate of alley resuriacing. The :inal cost <br />figure is $4,056.27 based upon the fact that the alley work actually cost less than <br />was estimated. This would make your share $2,028.14. Realizing that this is a <br />considerable sum, the City would probably be agrecable to accepting a promisory <br />note along with some form of payment plan. <br />Another factor which remains to be dealt with is the damage to the property below <br />yours. Apparently the property was damaged and the property owner has contacted <br />subm tted to the City a Both parties shou d acknowledge'the fac �tl at here may be <br />additional expenses. <br />Hopefully you are agreeable to resolving this matter at this time. I feel that i <br />co��ld recommend to the C'�ty that your contribution of $2,028.14 would be <br />appropriate under the circumstances.
