CONSTRUCTION, INC., a Washington corporation, for <br />and in consideration of ONE DOLLAR ($1) and other vaivable consideration, the <br />receipt of which is hereby acknowledged, does hereby grant and convey unto the <br />C1TY OF EVERL•TT, a municipal corporation, an easement for underground storm <br />water drainage iacilities over the s:,utherly most 9 feet of the following described <br />property (hereinafter referred to as the "property"): <br />Lot 7, Block 24, Plat of the Town of Lowell, according to plat <br />thereof, recorded in Volume 1�f Plats, page 11, records of Snohomish <br />County, Washington; except .ne South 40 feet of said Lot 7; situate in <br />Snohomish County, State ot Washington <br />ior the purpose. of construction and maintenance of storm water drainage facilities <br />together with the right to occupy necessary additiona! area (except �vhero <br />structure(s) are located) abutting the easement for purpose of coristructian, <br />reconstruction and mainteriance of such underground storm water drainage lacitity. <br />The Grantor, and its successors and �ssigns, hnreby cevenant to hold the <br />City of Everett harmless from any and all damagc occ.asioncd to thc property, or <br />struct�res, appurtenances, or personal property thereo .caus�d by or resulting from <br />ttie location or operation of storm water drainage facilities wht�h pcesently are <br />located upon said property; and further acknowledge that said sto: m water drainage <br />iacilities prescntly located upo;i said property are noS facilities of the City of <br />Everett, and said City shall have no responsibility for the maintenance the�eof. <br />The Grantor reserves the right to erect a building upon lhe pc�perty <br />immediately to the north of and adjacent tu the northerly mosi line ut the <br />easement herein granted.
