According to <br /> Snohomish County Assessor's records, insurance maps, and building permit history the <br /> duplex was established prior to December 1, 1956. <br /> The maximum density within an R-1 zone is one single-family residence per 6,000 <br /> square foot lot. This site is developed with a duplex (two-unit)structure. <br /> In addition to the nonconforming use on site it appears the residence fails to meet <br /> setback requirements for living space. In order for the City to certify the nonconforming <br /> setbacks a site plan would need to be provided which showed the location of the <br /> structure on site with respect to the property iines. At this time the structure has NOT <br /> been certified for nonconforming setbacks. <br /> Decision: I hereby find that the use for the above structure is recognized as a legal <br /> non-conforming use and meets the City of Everett Zoning Code in effect at the time of <br /> construction. This certification is subject to revocation if it is found that the infortnation <br /> upon which this decision was based is erroneous.
