The law creating these <br /> substandard lots has been changed by the City Council' s action on <br /> mer.ger. However, these lots can be developed as requested. It is <br /> suggested to the Applicant in developing the:;e lots to use all <br /> care and precaution to preserve the integrity of this neighbor- <br /> hood. The concerns of the Appellant� are valid. They should be <br /> given utmost consideration when developing the lots. It is final unless the following procedure is followed: <br /> 1. Any party aggrieved by the Everett Hearing Examiner' s deci- <br /> sion may file a written request with the Examiner for recon- <br /> sideration within ten (10) working days of the date of ihe <br /> Examiner' s decision. The request shall explicitly set forth <br /> alleged errors of procedure or fact. 'Phe Examiner shall act <br /> within ten (10) working days after the date of the filing of <br /> the request for reconsideration by either denying the re- <br /> quest, issuing a revised decision or calling f�r an addi- <br /> tional public hearing. If an additional hearing is called <br /> for, notice of set hearing shall be mailed to all parties of <br /> record not less than five (5) working days prior to the <br /> hearing date. The final date for requesting reconsideration <br /> is May 12, 1989. <br /> 2 . Within ten (10) working days after the Hearing Examiner' s <br /> action on the request for reconsideration, the aggrieved <br /> partp files a written appeal with the City Clerk' s office. <br /> If appealed properly, the matter will be submitted to the Everett <br /> City Council for further consideration. <br />
