I <br /> on the following described property <br /> I <br /> See Attachment "A" � <br /> � <br /> i <br /> i <br /> commonly Vmown as: 3601 Upland _ I <br /> I <br /> The Board of Ad�ustment, following a public hearing on said application held <br /> on September 8, 1986 and further having revieaed all testimony, makes the <br /> following Findings, Conclusions and Order: <br /> FINDINGS AND CONCLUSIONS: <br /> 1. That there have been exceptional or extraordinary circumstances or <br /> conditions applying to the sub�eet property or as to the intended use <br /> ithereof that do not apply generally to other properties in the same <br /> vicinity or zone. <br /> Finding: The R-S code states that the front setback shall be a minim� <br /> of 55 feet from the centerline xhen rights-of-way are less than 60 feet <br /> and one-half of the right-of-way plus 25 feet when rights-of-way are 60 <br /> feet or more. <br /> In this case� Upland Avenue has a 40 foot right-of-cray ahich would <br /> require that the house be 35 feet from the edge of the right-of-way. <br /> Most streets in the A-S zone have 60 feet of right-of-way whieh rrould <br /> requii•e the house to be only 25 feet from the edge of rigbt-of-way. <br /> The addition will be 29.5 feet from the edge of the right-of-way, ahich <br /> is still greater than that required in other R-S areas xhere the, <br /> �; right-of-iray is 60 feet. � <br /> i, <br /> � Since this is an addition to an existing structure, the area for� <br /> � expansion was limited. Had this been a vacant lot, a considerable� <br /> ' number of building/desiBi alternatives would have been available. The� <br /> lot is also sloped toxard the side and rear and this also placed some� <br /> restriction on the design and lecation of the addition. ! <br /> The prop�sed design and location of the addition alloWs for best use of; <br /> available space while preserving the best floor plan for the intended' <br /> use by the family.
