Harringan: CITY HALL • 259-8755 <br /> EVERETT.WASHINGTON <br /> On July 5, 1990, a STOP WORK ORDER was posted on your property at 3624 Upland <br /> Avenue. <br /> The order was posted to prevent any further development or destruction to the <br /> upper slope (north side) of Edgewater Creek. <br /> On July 10, 1990, the area was inspected by the State Department of Wildlife and <br /> a City Engineer. Both inspectors documented the instability of the slope, the <br /> elimination of vegetation and potential for further destruction to Edgewater <br /> Creek. <br /> The development activity which has resulted in these conditions is in violation <br /> of Section 37.160 Development Activity and Improvements in or near a stream, lake <br /> or wetland. <br /> 1. General. No development activity may take place, nor may any <br /> improvements be located, in a stream, lake or wetland except as <br /> specifically provided in this Subsection or as otherwise permitted <br /> or required under the Shoreline Master Program. In addition to the <br /> requirements of this Subsection, the applicant shall obtain all <br /> necessary State and Federal permits. <br /> 2. Rehabilitation. The City may permit or require the applicant to <br /> rehabilitate and maintain a stream, lake or wetland by removing <br /> debris, sediment, vegetation, or other material detrimental to the <br /> area, replanting disturbed vegetation, or by other methods deemed <br /> appropriate by the Planning Director. Rehabilitation may be <br /> required at any time that a condition detrimental to water quality <br /> or habitat exists. <br /> The enforcement provisions which are detailed in Section 37.200 are as follows: <br /> B. Any person, firm , corporation, or association or any agent thereof who <br /> violates any of the provisions of this Section shall be guilty of a <br /> misdemeanor punishable by a fine not to exceed $1,000.00. It shall be a <br /> separate offense for each and every day or portion thereof during which <br /> any violation of any provisions of this Section is committed. <br /> C. Any person, firm , corporation, or association or any agent thereof who <br /> violates any of the provisions of this Section shall be liable for all <br /> damages to public or private property arising from such violation, <br /> including the cost of restoring the affected area to its condition prior <br /> to such violation or to such other condition acceptable to the City. <br />
