Harringan: CITY HALL • 259-8755 EVERETT.WASHINGTON On July 5, 1990, a STOP WORK ORDER was posted on your property at 3624 Upland Avenue. The order was posted to prevent any further development or destruction to the upper slope (north side) of Edgewater Creek. On July 10, 1990, the area was inspected by the State Department of Wildlife and a City Engineer. Both inspectors documented the instability of the slope, the elimination of vegetation and potential for further destruction to Edgewater Creek. The development activity which has resulted in these conditions is in violation of Section 37.160 Development Activity and Improvements in or near a stream, lake or wetland. 1. General. No development activity may take place, nor may any improvements be located, in a stream, lake or wetland except as specifically provided in this Subsection or as otherwise permitted or required under the Shoreline Master Program. In addition to the requirements of this Subsection, the applicant shall obtain all necessary State and Federal permits. 2. Rehabilitation. The City may permit or require the applicant to rehabilitate and maintain a stream, lake or wetland by removing debris, sediment, vegetation, or other material detrimental to the area, replanting disturbed vegetation, or by other methods deemed appropriate by the Planning Director. Rehabilitation may be required at any time that a condition detrimental to water quality or habitat exists. The enforcement provisions which are detailed in Section 37.200 are as follows: B. Any person, firm , corporation, or association or any agent thereof who violates any of the provisions of this Section shall be guilty of a misdemeanor punishable by a fine not to exceed $1,000.00. It shall be a separate offense for each and every day or portion thereof during which any violation of any provisions of this Section is committed. C. Any person, firm , corporation, or association or any agent thereof who violates any of the provisions of this Section shall be liable for all damages to public or private property arising from such violation, including the cost of restoring the affected area to its condition prior to such violation or to such other condition acceptable to the City.
