<br /> WHEF{EAS, Owner has applied for a permit trom the City of [verett which
<br /> under Ordinance 555-78 and subsequent arnendments thereto require certain improve-
<br /> ments to be made to public rights o[ way as a condition to issuance of certain City
<br /> permits; said Ordinances allow that the City Engineer may accept a covenant consenting
<br /> to the tormation ot a local improvement district in lieu of havi�g Owner construct
<br /> and install the required public irnprovements.
<br /> WHEREAS, Owner's property and the adjacent public rights o[ way have
<br /> been determined to require a covenant consenting to tlie formation ot a local improve-
<br /> . ment district rather than having Owner make specitic improvements.
<br /> NOW, THER[FORC•, in consideration of issuance ot applicable City permit(s)
<br /> pursuant to Ordinance No. 555-78 and subsequent amendments thereto and in lieu
<br /> of certain public right o[ way irnprovements Owner consents to the tormation ot
<br /> a local imFrovement district hereatter formed by the City or its successors or
<br /> other property owners for the public improvement of:

<br /> uch local improvement district including natvre and type of improvements as well
<br /> s the proposed or final benefits and assessment theretor.
<br /> The City shall deliver a signed relcase o[ this Covenant to Owner after completion
<br /> f public improvements as described hereinabove through the tormation of a local
<br /> mprovement district and atter trans!nittal of ttie tinal assessment roll to the County
<br /> t Snoliomish pursuant to law. Ttie City may not utilize tliis Covenant for the formation
<br /> f mQle than one (U local improvement district.
