<br /> WHEREAS, Ordinance No. 555-78 was enacted to zeduce the adverse ef�ect
<br /> of increased vehicle and pedestrian traffic on existing neighborhoods and
<br /> provide safe and efficient facilities for vehicle and pedestrian trafficj and
<br /> WFiEREAS, Ordinance No. 555-78 requires, in part, a developer to impmve
<br /> street and alley rightsrof-way; or at the discretion of the Ci.ty Engineer, a
<br /> developer may convey and execute in the favor of the City of EveretL- an
<br /> irrevocable power of attorney for the sole purpose of casting a vote, siqning
<br /> a petition or othezwise assenting to the formation of a Local Impmvement
<br /> District.
<br /> NOW, Tt�REFORE, in consideration of issuance of a building pezmit,
<br /> pursuant to Ordinance No. 555-78 and in lieu of certain required street'end/or
<br /> alley improvements, Bov$Pn Rea�+y.� Inc. (hereinaEter
<br /> reEerred to as "Developer") , and pursuant to Ordinance No. 555-78, haa ma8e,
<br /> constituted and appointed and by these presents does make, constitute and
<br /> appoint the City as true and lawful attorney for it and in its name, place
<br /> and stead, and as an irrevocable pmxy to cast a vote for approval, by
<br /> petition or otherwise, of any Local Improvement District hereafter formed by
<br /> the City, its sur.cessor or other property owners in a henefit area encompassingi
<br /> for ultimate street and related improvements pursuant to Ordinance No. 555-7�, If
<br /> as it presently exists or is hereafter amended or supplanted. I

<br /> This power of attorney shall be a conveyance of an irrevocable interest: �
