 I
f
% BOARD OF ADJUSTMEHT
iFIlIDZNGS CONCLUSIQNS AND ORDER
I
VARIANCE N0. 22-87
I
'I Eased upon the rrritten request for a variance from the City`s zoning code by:
Aick Graff
7003 Woodlawn
Everett, WA 98z3
hereinafter referred to as "Applicant," for a variance from E.M.C.
19•12•060, Height, to allox:
a 27.5 foot height limitaticn rather than the 25 foot limitation
required by Code.
on the following de :lued property:
 Lot 8, Kenilworth Hills Div. 5 25ie - ViEui.EST r9vr.
The Board of Ad,justment follor+ing a public hearing on said application held
cn June 1, 1987 and further having reviexed all testimony, makes the
following Findings, Conclusions and Order:
'' FINDINGS AND CONCLUSIONS:
I
; 1. That there have been exceptional or extraordinary circumstances or
conditions applying to the sub,ect property or as to the intended use
thereof that do c.ot apply generally to other properties in the same
I vicinity or zone.
I a. Finding: Tle applicant is attempting to maintain a
, traditlonal two-story house style which already has been
established in the neighborhood. If he Nere to lower the roof
li pitch to a 5/12 or 4/12 in order to meet the 25-foot hnight
limitation, it would drastically alter the appearance of tha
istruoture, and this is not aeceptable to hi clients.
 b. Conclusion: Tne proposed variance appears to be a reasonable
Irequeet.
i 2, That such varianee is necesary for the preservation and enoyment of
a substantial property right of the appellant possessed by the odners
I of other properties in the same vic.tnity or zone.
a. Findin : Similar variances have been granted to ther
II properties in the area, includSng one to the appllcanC ior Lot
 3 of Kenilworth H121s Div. 5 granted on January 6, 7987.
b. Conclusion: 'The variance would allow a property right
possessed by other owners in the vicinity.
3, That the authorization of such varianee uill not be materially
detrimental to the public welfare or inurious to property in the
vicinity or zone in uhich the property is l.ocated.
i
 a. Findin : No comments were received from other City
! departments. The viexs from this ac•ea are to the north. Since
all existing residential development is to the north, east or
west of this lot, it will not create view blockage. The
property is bounded on the south by a 75-f'oot greenbelt buffer,
which effectively eliminates any future concerns about view
blockage to those properties.
;
f
E
