On February 21S%2007 a Public Hearing was held. <br /> The proposed vacation is an adjunct to the Everett Community College's Master Plan and will allow the College to <br /> reconfigure its development of a parking garage on the site,thereby lessening its impact to the adjacent neighborhood. <br /> After the Public Hearing,Council directed staff to prepare the vacation ordinance subject to: (1)the retainage of <br /> easements for utilities,which easements will automatically terminate upon the removal and relocation of all utilities <br /> within the said right-of-way by the petitioner;(2)compensation by the petitioner to the City of Everett for the right-of- <br /> way being vacated in the form of an exchange of real property and a dedication of new right-of-way from the <br /> petitioner to the City of Everett;(3)the petitioner shall provide a new public trail for pedestrians and bicycles between <br /> Tower Street and the new southern terminus of Waverly Avenue;(4)the vacated portion of Waverly Avenue shall <br /> remain open to Everett Transit bus traffic until such time as the new North Everett Transit Center is completed and <br /> operational; and(5)the Petitioner shall construct a new cul-de-sac meeting City of Everett Design and Construction <br /> Standard and Specifications at the new southern terminus of Waverly Avenue. <br /> RECOMMENDATION(Exact action requested of Council): <br /> Adopt proposed Ordinance vacating of a portion of Waverly Avenue north of Tower Street. <br /> 28 <br />
