That there have been exceptional or extraordinary circumstancoe or
conditions applying to the subect property or as to the intended use
thereof that do not apply generally to other propertiEs in the same
vicinity or zone.
a. Findirg: The applicant is attempting to maintain a
tradicional two-story house style which already has been
esta>>lished in the neighborhood. If he Nere to loxer the roof
pitc to a 5/12 or 4/12 in order to meet the 25-foot height
limitation it r+ould drasticaliY alter the appearance of the
I struct:ure, and Lhis is not aceeptabla to his liente.
' b. Coneli:lon: The proposed variance appears to be a reascinable
requeet.
II 2. That sunh varlance is necessary for the preservatiun and anoyment of
I a aubetantial proFerty right of the appellant possessed i,y the owners
I
of other propertiea in the same vicinity or zone.
 a. FindSng: Similar varianees have been granted to other
properties in the area, including one Lo the applicant for Lot
i 3 of Benilwortt Hills Div. 5 granted on January 6, 1987.
 b. Conclus'...n: Tha varlance xould allow a property right
i, possessed by other oxners in the vicinity.
I 3• That tha authoMzation of such ariance Will not De materially
detrimental to the public aelfare or inurious to property 1n the
vicinity or zone in which the property is located.
 a. Findin: No comments were received from other City
departments. The views from this area are to the north. Since
all existing residential development is to the north, east or
xest of thia lot, it Will not create viex blockage. The
prperty is bounded on the outh by a 75-foot greenbelt buffer,
>+hich effeciively eliminates any future concerns about view
blockage to those properties.
